The story states he went to Lawyers to ask legality. Why? Who in their right mind doesn't see that this is not a good course of action. I am not sure if he went ahead with the proposed actions but I would guess that is what initiated charges.

I agree, but the fact that he DID take it to the lawyers first. If they told him it was a bone-head idea and not legal ... what's the issue? The number of times I've heard bone-head ideas coming out of our GOFOs is a bit mind-numbing. I don't think I ever heard one talk about setting up a sniper's hide on the second floor of his house though.

Why relieve a commander because he was thinking about something? It's not like he actually did it (at least from the story). If he DID do it, then that's another thing and I can absolutely see him being relieved for that.

There has to be something else because this would be in the category of "you're relieved because the thought police are shutting you down".
