I think attempted murder is a stretch. I can see the charge, because he had disarmed the attacker, and it could be argued the attacker was no longer a threat. I disagree, because the garage worker was gut shot, and knew it. That is, generally speaking, a relatively debilitating wound. There is no indication the assailant was shot in the back while fleeing, which to me says he was still a threat.

So, I don't agree, but I can see a way someone can work their way there.

But weapons charges? Seriously?

Note to all New Yorkers: you are no longer allowed to disarm your assailant.

I mean how asinine can we get? There is a certain convoluted logic to the attempted murder charge. There is NO logic to the weapons charge.

Just when you thought the Liberal Logic couldn't get any worse...I thought the bodega clerk last July was possibly an isolated incident, but Alvin does it again!

The attendant was shot in the stomach and almost had his head blown off with another shot by the criminal ... managed to wrestle the gun away from him and then shoot the criminal in the chest. For that he gets slapped with an attempted murder charge.

At first I was thinking it was a situation where he shot the thief while he was running away or something like that ... Nope. Criminal draws gun ... tussel for gun ensues .. victim gets shot twice by criminal .. victim wrestles gun away and shoots criminal.

I wish that just once the Soros funded DAs would have to live with the policies they put in place instead of being insulated from them.

Well, you know, if we let this guy get off with taking a gun away from the perp, next thing you know people will want their own guns to defend against perps, and we can't have that!!
