Conservatives are always yelling about "States rights." So should it not be up to the state as to who can be on the ballot?

SFC Casey O'Mally - In Arizona where I now live, the only requirements are dates and percentages of signatures on a petition to be included in the primaries. Can that be changed to include other factors? I don't know.
But, I think we will see the entire 14th Amendment clause be settled, for now, by the US Supreme Court.

SFC Casey O'Mally - By the way, I think the US Constitutional requirements for POTUS were written by men who believed any candidate would be virtuous and honest. Were they wrong?
"No person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any Person be eligible to that Office who shall not have attained to the Age of thirty-five Years, and been fourteen Years a Resident within the United States."

I think this is a very difficult one to balance. Yes states should be allowed to set how they elect people however for a federal office like president if several states do not allow a person on the ballot for president they could effectively prevent that person from winning despite how the other states vote. I don't think it is fair to other states for anyone but in a general election to keep them off the ballot. I do not think the governor of a state or state legislature should decide, I think it should be the people of the state. Most states it is winner take all on the electoral vote and whether the decision to allow them on the ballot or not if you let the people of the state have a voice at election time it would equate to the same outcome but the people of the state would have their voice heard.

..."MINNEAPOLIS (AP) — Former President Donald Trump will stay on the Minnesota primary ballot after the state supreme court on Wednesday dismissed a lawsuit seeking end his candidacy under a rarely-used constitutional provision that forbids those who “engaged in insurrection” from holding office.

Minnesota Supreme Court declined to become the first in history to use Section 3 of the 14th Amendment to prevent someone from running for the presidency. The court dodged the central question of the lawsuit — does Trump’s role in the Jan. 6, 2021, attack on the U.S. Capitol disqualify him from the presidency — by ruling that state law allows parties to put whomever they want on the primary ballot.

“There is no state statute that prohibits a major political party from placing on the presidential nomination primary ballot, or sending delegates to the national convention supporting, a candidate who is ineligible to hold office,” Chief Justice Natalie Hudson ruled.

The court left open the possibility that plaintiffs could try again to knock Trump off the general election ballot in November. The Minnesota challenge was filed by the liberal group Free Speech For People, which said it will continue its campaign to end Trump’s presidential bid.

“We are disappointed by the court’s decision,” said the group’s legal director Ron Fein, who argued before the court at its Nov. 2 hearing on the case. “However, the Minnesota Supreme Court explicitly recognized that the question of Donald Trump’s disqualification for engaging in insurrection against the U.S. Constitution may be resolved at a later stage. The decision isn’t binding on any court outside Minnesota and we continue our current and planned legal actions in other states to enforce Section 3 of the Fourteenth Amendment against Donald Trump.”"
