I think they got it right. Supremacy Clause says federal government gets to.make the rules. There is no requirement that they make GOOD rules or even that they enforce them. Just that the feds get to make the rules. And if the feds say open borders, open borders it is.

I am not saying I agree with the federal government on their approach, policy, or implementation. But on the legal point, I think their case is pretty cut and dry.

Where so many are misunderstanding this case is, "The DHS stated federal law gives Border Patrol agents authority within 25 miles of the border, and the razor wire impeded the federal agents’ ability to apprehend migrants." Biden's lawyers are smart and outwitted Texas. Why Biden is spending so much time and money fighting TX solutions is beyond me.

MAJ Byron Oyler I agree 100%. The sad fact is that the administration is not doing their job, so Texas stepped in to do it for them. A smart administration would have thanked them for the help.

But, despite all that, it is still the federal government's purview, regardless of how incompetently they are carrying out their duties.

MAJ Byron Oyler - Actually the Border Patrol has a 100 air mile zone in which they can conduct operations. Within 25 miles they have free range on all land without a warrant. Thus Texas was violating the law by excluding BP from their duties when Texas took land without any right to do so.

Unfortunately Texas doesn't have the right...it will get restarted in 2025 but in the meantime....

I'm going to say SCOTUS got it right. The agency that is responsible for border security want to handle the job the way it wants to. That is not to say that they are in fact securing the border. SCOTUS should not legislate. Now where does the federal "border" stop and where can Texas defend itself?
