I am tired of hearing all that crap trotted out time after time when the person makes accusations and then when confronted with facts, uses these accusations to try to shut down the argument. But I am not sure you can do this...free speech...free to prove yourself an idiot.

SGT (Join to see) well you certainly don't speak on behalf of SCOTUS... also it is a civil tort.. Which is a dispute between private parties... So none of your amendments apply.

SGT (Join to see) times vs Sullivan on qualifies public officials to prove actual malice in defamation cases.. Which is the previous and only SCOTUS decision you can refer to.

SGT (Join to see) however when Jefferson spoke of criminilization of defamation.. He was referring to imprisonment... Since you can't be jailed or face criminal penalties from this law.. And the state is not the plaintiff... None of the amendments can be asserted to private party plaintiffs.
