It's a very optimistic interpretation by this MAGA content creator.
However, the judgement defines members of the class as pertaining to their specific situation "at the time of said person's birth", when referencing class members not already born.
Thus they become a class member based on their situation "at birth", and not based on what their situation "will be in the future when they are born".
They only meet the class criteria when born.
