Sex crimes can be confusing. It is crazy how you can legally have sex with someone (Maryland law allows for 18 year olds and 14 year olds) but then if you have a video, it's illegal. Depending on the state, you can get oral sex from someone legally considered a minor, but if you video it, you are wrong? if you read Maryland law, sex between an 18 year old and 14 year old is legal, but there is no exemption for electronic solicitation between the same two. So if an 18 year old and 14 year old text about hooking up and later hook up, the 18 year old could later be charged with a violation of the electronic solicitation but not the actual sex. Would they actually take action on that? Who knows.

He's charged with transmitting child porn since we're talking about explicit, assuming nude, photos of a minor. Has nothing to do with consensual sex.

I know that. I am just pointing out the irony that the actual sex act with a minor is okay, but the same consensual encounter cannot be recorded.

Yes, no one, especially the Chief Law Enforcement Officer of the US, should spout opinions in legal cases. Don't you wish President Obama has learned that in all of his eight years? Let's hope President Trump is a better learner.
