Witt's death sentence was overturned on appeal, and on re-trial, he was sentenced to life without parole. Also, A1C Mark Gooch will likely not see a court-martial, but will be tried by civil authorities.

Kirtland AFB is taking the case of an Airman as we speak for a vehicle negligent homicide that happened off base and involved a civilian not associated with the DOD.

Capt Gregory Prickett
Lt Col (Join to see) - I didn't say that it couldn't happen, just that it's not likely. Hell, if Arizona wants, it can still try him whether the military does or not.

Lt Col (Join to see) Yes. Local law enforcement has always worked with the Provost Marshall and SJA on who will have jurisdiction of a Servicemember that commits a serious felony off base/post. I’ve seen it goes both ways with the expectation that he who gets jurisdiction is not only going after the more serious conviction & punishment but also accepts the burden of confinement and prosecution.
