Since it is doubtful he has completed his military commitment (8 years upon enlistment) he is likely in the Inactive Reserve.
He has confessed and bragged about his deliberate assault on an NCO in his video.
Recall him to Active Duty, Courts Martial him and give him a DD with jailtime.

CSM Clifford Fargason
SPC Justin Foster - The guy is bragging about it in a video, how much more investigation do you think is needed?

CSM Clifford Fargason - My point was that in a culture that literally is based in large part on violence, when you agree to let a lower ranking individual hit you int he face with something, wouldn't you think that something like this is bound to happen?

SPC Justin Foster - Even in an ill advised event like that, the junior enlisted knew what he was doing, therefore the bragging.

CSM Clifford Fargason - Fair enough.. I'm not saying he wasn't being a moron, only that putting someone in a position to hit their superior in the face with anything probably isn't a great plan.. and apparently those closest to the situation didn't feel it was worth UCMJ action, so there must have been a reason for it.

I have been trying to wrap my head around what this video shows as well as what isn't shown-the background info about which I can only guess. I have also shared it with my Soldiers and asked their thoughts. The fact that it was a Signal unit hits especially close to home.
BL: this is sickening, for several reasons. The SM clearly assaulted the NCO in the video, at a family event, in front of children, and then has the unmitigated audacity to brag about it on social media. I am also perplexed as to why NO ONE stepped in immediately.
An alarming number of commenters automatically make the assumption that the NCO somehow "deserved" to be sucker punched in front of his family. Even if that NCO was garbage, that in no way justifies the assault, and furthermore there is nothing to support that assumption as the subject himself makes no attempt to justify his actions.
I'm also curious as to why no UCMJ action was pursued. I'm tracking there was already a pending chapter (and sometime we just want our problem Soldiers gone), but in this case there is absolutely no way I as the commander would let that individual leave the army with his benefits intact.
