True but FCC rules aren't constitutionally enacted laws. If AT&T and the other telecoms can buy enough U.S. Senators and Representatives the states would be powerless to do anything about it but it's real expensive to buy such an overtly anti-consumer piece of legislation especially going into a mid-term election year with the Republicans who control congress looking more vulnerable than they have in decades.
