Unfortunately, ICE's hand are tied by presidential policies. If an illegal alien gets convicted of robbery (an aggravated felony) and a "nice" judge gives him a one year sentence but suspends 9 months of it, ICE can only act on the actual time imposed (3 months) and this doesn't meet the guideline for aggravated felony. It has to be an aggravated felony resulting in one year of prison time. So the subject gets out of the state or local jail, given to ICE, and they are forced to release this person, even though the individual officer is disgusted by this. People are getting deported more often by DUIs than serious crimes because of policy. If this happens 3 times, then removal proceedings could begin. It can be a pretty complex process at times. Then the person can always claim asylum and they feel endangered if they are returned to their home country. The asylum courts are back up for several years but everyone is given a chance to have their case heard because this is America and we have a constitution that gives rights to illegal aliens, not just citizens.

If a person is from Iran, North Korea, El Salvador and many other countries and they get convicted of rape and do 15 of their 25 years sentence, they are released because their country will not take them back. As far as the judicial system is concerned, they have done their time but their country will not take them back and ICE cannot hold them just because they are bad people. Talk to the US Supreme Court about that because it has been decided that aliens that have been convicted of a crime and have served their sentence but cannot be deported cannot be held awaiting deportation when there will be no deportation. So yes, people are being convicted of crimes, given light sentences by our wonderful judges and released back into society because of policies and countries that will not take them back. Haiti is a country that will not take back their people and a lot of Haitians commit crimes once they enter the US. Crimes such as petty theft, bad checks, simple assault, driving without a license, and the like are crimes for which aliens are not being placed in removal proceedings right now...due to presidential policy and directives. So when they speak of aliens committing crimes and being released back into society, they are right and it is sickening. Then you have these states and cities that are safe havens and they do not even contact ICE when they arrest an alien. Others do not honor ICE detainers. They know they have arrested an alien for a serious crime and that has previous convictions and ICE would like to get them but they will not hold them for ICE.

CMS,
Almost 20% of Federal inmates are illegal aliens. Mostly from Mexico. They go to prison. When their jail time is finished, they are suppose to be deported.
I suspect, due to man power issues with ICE and the current administration love of Marxist voters, that does not happen.
Illegal aliens are used to change culture and increase profits for the companies that run jails.
I read a lot of non US citizens vote for more Marxism.
The poor from Mexico do not realize they are just pawns in a much larger political agenda.
Have a good evening,
M. Morris RVT
