I really think this whole Court-Martial is wrong. They were both drinking , however the deceased was very drunk and acting erratic/violent and trying to go into the ocean. His friend tried and prevented him from hurting himself , while the accused was awake. It seems after he fell asleep , the other guy simply went into the water , passed out and drowned.

It looks very kangaroo courtish, IMO the whole thing looks like protecting higher ranking people and railroading this young guardsman
