Court upholds Trump travel ban, rejects discrimination claim

The only surprise here is there were 4 justices that voted against upholding the ban. Some of us here predicted this would be the way it went. Others were sure the SC would stop Trump on a fully constitutional action.

This is the fallacy of the dissent's argument. She is worried about the pain and suffering this might impose on countless families. That is another emotional argument and walks right past the Constitutional, the law and the President's authority under the law. The fact that this was not 9-0 tells you all you need to know about what has happened to the supreme court and the politics, feelings and emotion that have crept into its opinions.

Sotomayor wrote that based on the evidence in the case “a reasonable observer would conclude that the Proclamation was motivated by anti-Muslim animus.” She said her colleagues in the majority arrived at the opposite result by “ignoring the facts, misconstruing our legal precedent and turning a blind eye to the pain and suffering the Proclamation inflicts upon countless families and individuals, many of whom are United States citizens.”
