In the article it states that Cuomo took issue with a reporter stating that he was seizing the ventilators, instead that it was “sharing of resources”. If he uses the NG to take them without being volunteered, then he is seizing them.

Lt Col Charlie Brown seizures persuant to a criminal investigation is slightly different than this though. That being said, even some of the seizures by PD has been overreach by the local governments.

The problem with eminent domain in this situation is that of for the public good of taking from one public good to give to another public good. The next problem, they (the State of New York) have not exhausted what they have stockpiled in storage before plundering (because that is what it is) a lesser part of their citizenry.
In other words, it is a needless self-destructive over-reaction to the problem. To say it another way - "Cutting off the nose to spite the face."
