Wow considering that to my knowledge those that do so these days are usually just administratively discharged, with at worst a bad conduct. There must have been some special circumstance involved for this to still be in the system.

Maybe it's because when he deserted it was still during wartime from Vietnam?

IIRC the few times we had someone desert when I was in the Navy the people did end up having to spend 30-60 days in the brig before they got kicked out with a bad discharge (I think Big Chicken Dinner)

In addition.... that 30 day sentence not enough... In ‘78 the police action became a war and the guy was still in the lam.. by all rights he should have been executed. I think some others may agree.. that point was commented on.. the judge commented that because when the guy went U.A. It wasn’t a war so so execution is not on the table... is that is decision or U.S. Code? I wonder... is there a diff if a guy goes U.A. during a “Police Action” or a war? To me it shouldn’t matter. If that’s the case.. how many others that went U.A. And went to Canada.. came back and went to prison and given Life sentences.. Jimmy Carter.... gave amnesty to thousands that deserted the draft and Mitary that went U.A. To Canada.. maybe because he May had taken into consideration it was a “police action” at the time.. that had a unmentioned minute part in the
amnesty.. I know he had a nephew or some relative that had deserted.. answering the draft call.
If there’s a difference between going U.A. During a “Police Action”
Or going U.A. During a “war” it needs to be noted in the U.C.M.J.
as to penalty incurred/called for..
I know we have some J.A.G. Out in RP.. I know we had a guy who barely missed a deploy call-up.. got burned for missing it anyway.. his back-up on team 2 had to be brought up to A-team so the team could deploy... the late one was moved to team 3 which didn’t deploy... s’body from 3 moved up to 2 to fill that guy who moved to one .. The late guy got action taken when it was over in 2 months.
He got off with a art 15 for miss’g Movement.. it might had been a court martial for missing a formation in connection with movement. It was a trying sit-rep.. a lot of screw up in connections getting over to _________, people were plumb worn.. We lost a lot of points because evaluators tied it into the ORI we had going on.. The loss was not supposed to be on us but USAF Europe Command.. So by time the court martial was to be scheduled, the Cmdr. Called it off and reduced to art 15.. The Airman got off.. He said he kind of wanted the CM because they were taking too long to do the court martial if it would of happened and his Jag guy thought they could get charges dismissed because of not getting a speedy trial.. (IMHO) I believe changing to an art. 15 kind of made sure the cmdr could bring some justice into the scenario..

I meant to add a Senior Cmnd Ofcr or NCO that has good knowledge about the UCMJ where it has s’thing to do with missing a movement/formation..
