The two situations aren't quite the same thing. O'Donnell's violation is a civil one, even with the suspicious address and minor name variations. The FEC could fine her, but the established remedy is refund or redistribute. D'Souza, however, used straw donors which is the big no-no in campaign finance law. You're screwed if you use straw donors. Unsatisfied with a simple civil violation, D'Souza stepped right off into felony territory when he funneled the money through other people.
A more equivalent example would be Sant Singh Chatwal, a friend of the Clintons that used straw donors to give money to HRC's 2008 campaign. He too was charged in early 2014 by the same Obama FEC and similarly plead out.
The key take away is this - Don't use straw donors. Ever. That's how you go to jail. Also, D'Souza has become a whiny political hack that never seems to take responsibility for anything.

Sgt Wayne Wood - ActBlue does not conceal your identity or pretend to be someone else. It's a donation platform like GoFundMe that just facilitates the movement of money between donors and campaigns/organizations. Think of it more like Amazon when you buy third party. The seller knows the money comes from you, even though Amazon handled the transaction.
If you give me money for a specific candidate and I donate in your name, I am not a straw voter. If I donate in my own name, congratulations, we can be twinsies in jail!
