Seems odd that a basic fact is in question. The lawsuit says the girls were banned from extracurricular activities while the school says they were never disciplined at all. I can see how the defamation thing can be a judgement call, but whether they were banned or not should be straightforward.

"The controversial picture, widely circulated on the internet, depicted eight smiling white teenage girls dressed in white shirts, raising their hands over their heads in an ambiguous gesture. The image was captioned with the letters “KKK” — the initials of the girl hosting the party — and posted to social media, according to the lawsuit."---Chicago Tribune exert
How dumb can you be to post a photo on social media with the caption "KKK" and expect folks will know it's the girl's initials and not reference to the Klan?
