Do you know the rest of the story? British government had demanded his release because of the torture allegations while he was in Gitmo and he was still a British citizen. Also add the US military didn't have sufficient evidence to put him on trial for anything. That's what happens when you choose not to put someone on trial and torture the citizen of an allied government; bad guys get released, almost like a mistrial of a murderer who's confession was obtained under duress. Oops, we eff'd up.
