Judge orders asylum-seeking mother, daughter returned to U.S.

My knee jerk reaction to this is to ask why a judge is enforcing a UN rule. However, if the US signed a treaty that we have violated, then the judge has such a right inasmuch as treaties carry the force of law if they have been ratified by the Senate and signed by the President. Has this one? Can't say... Now that brings us to the question of refugee status. Is this woman a legitimate "refugee"? Obviously, she is a refugee from spousal abuse, however, if that qualified there'd be a helluva lot of women seeking asylum all over the world. Sadly, this is a far too common problem, one that I'd love to resolve with a little applied physics.
