I support his right to protest. I do not support the manner in which he did it. But, being in the uniform certainly ensured he would get noticed.

And it protected him from arrest. Imagine the PR nightmare the local police would have had on their hands had the evening news showed them dragging the Chief out of the surf and cuffing him.

How do we 'know' (as in having admissible evidence to a UCMJ proceeding) he was protesting the beach closure? He never made any sort of statement. He just stood silently in front of a sign that proclaimed the 'Land of the Free' (a statement from our National Anthem) for 10-15 minutes and left of his own accord.
I think the ol' Chief may be a bit more clever than the barracks lawyers think and just pulled off the uniform crime of the century!!!!!
