"Rugh said that he’d already acted three times to punish the prosecution — by removing Gallagher from pretrial restraint; disqualifying Czaplak as prosecutor; and delaying the trial to June 17 to give the defense more time to prepare for it."
I am not a lawyer. But I did read the article. IMO, this Judge didn't just square away this investigation and near future trial. With the added correct type of Jury members, mostly combat Marines, Gallagher will be given the correct type of review when the case goes to Jury.
I'm betting he is found innocent and then he can sue Czaplak and the NCIS officials who tried to screw him.

If they violated his rights, than he does deserve to have the case dropped like a hot tater.
