This brings up a question for me. How does this affect a active duty SM when they break civilian law. Does the State take possession of him or do they go to Ft. Leavenworth to serve their time?

I believe once the servicemember is convicted in civilian court, the military can then pursue charges under UCMJ and seek to have the service member serve the punishment in military prison.

SSG(P) (Join to see) - I was thinking the Army works with the local DA and depending on the seriousness of the charge (state or federal felony). The army would be lead in the federal felony case instead of the state?

It's usually left up to the civilian authority, usually a meeting of the minds, often which ever can be more severely prosecuted gets the nod.
