I don't think that will work. Remember the Supreme Court canceled the president's recess appointments by a 9-0 decision, the issue was so clear cut that even the liberal activist judges had to rule against the executive branch in that case. I know we're not talking about exactly the same thing, but that should be an indication of how seriously the Senate's role is seen.

Common cause s a Democratic leaning organization . I didn't hear much objection when Dems said they would block Bush's Supreme Court appointments for 18 months.

LTC David Brown - so they never blocked a scotus nominee from a hearing. And do you really believe that president Bush would have withheld nominating someone just because the opposition party said he. Shouldn't? The truth is that this senate obstruction has never happened before in our history. The republicans have taken their opposition to Obama to the point where they are willing to completely ignore their constitutional duties. It's unprecedented and pathetic.

Only if they go on recess and then its just a temp appointment I believe. Not to mention he has already been slapped around by the courts for illegal action regarding appointments. Not sure he will try that move again.
