Lawyers will muck this up. How many young people get married hoping to split a retirement. Lost touch with reality. My ex fought for this and we were married 4 years. I was in for 3 years before we met and we were both E3s and was an E5 when we split. I am now an O3E with over 30 years. She would have made out very well indeed for not much input into my career. See both sides and should not be based on state law and many things should be considered when deciding it.

I agree with Capt Hogan. It should be based on when they split and pay table for that time period.
The spouse should only recieve % for what time they were actually married up to the time of divorce.

This would be most Helpful To many of the Guys I know...
because many were married several Times for between 8 to 12 years and They had to continue to work Just to Pay the bills after they retired because they were paying so much to the alimony/spouse Payments
in the 1990s HRC pushed issues for the spouses could Get a portion % of the service Members retirement if married More than 5 Years and less than 10... and after 10 they can receive 35-50% depending on the Length of time Married, and how many other Spouses the Service member had and is Paying Divorce settlements to...

It still takes a judge to make any distribution of retirement benefits. Its not automatic.
My advice to those that divorced or plan to divorce is to sever communication and stop stalking them on Facebook. Become invisible. If they don't know you retired, they can't try to get your benefits.
