"Politically tainted judicial system"., where have we seen this before? There is nothing wrong with the system. Man has corrupted it. Man will corrupt the next one. Enforce standards at every echelon. Recruit upright citizens. Make service a calling rather than a social experiment. Bring back honor in our system. Bring back principles and morals and the system will work. We are all guilty of allowing men and women of a substandard nature to positions of power and influence. And we are surprised at their human failings?

There have been several cases that admittedly have involved unlawful command influence. Hell from our former POTUS on down, it's not the only issue but one of the reasons there needs to be hearings and change.

MSgt Lisa Silva - OK, so we have had the UCMJ for lets call it 100 years. And there have been "several" cases that involved command influence. So what is the solution? How is changing the system going to help? How do you eliminate Command Influence? You simply can't. As a Commander you will understand say when a Division Commander wants you to do something his/her way. You might not like it but that is command influence. It can be direct as in an order or indirect as in a poorly written OER. Changing the UCMJ will not change command influence.

It's not the only issue,
➢ Preferring criminal charges to court-martial based on false allegations or which lack sufficient probable cause for prosecution.
➢ Excessive military prosecutorial and law enforcement agent misconduct.
➢ Rogue military prosecutors and law enforcement agents.
➢ Failure on the part of military prosecutors and law enforcement agents to pursue evidence of innocence.
➢ Failure to comply with discovery obligations.
➢ The enticement of lavish financial compensation packages encouraging many to make false allegations.
➢ The failure to hold those accountable for filing false allegations.

MSgt Lisa Silva - I understand the points there but that has nothing to do with UCMJ. That is unscrupulous people using specific questionable techniques. I'd like to know how anyone could address your last point. False allegations are made every day in the Army and I witnessed a BN CDR that was relieved because of false allegations. It may not be right but the current culture and weak leaders allow it to happen.
