He will get off... here’s why. No benifercsries listed. 2. The responsablity of reporting the death was not his responsablity and they will not be-able to prove he knew otherwise or that he was compled to report it or even that he knew the source of the deposits. 3. The money was taking out of an account that he had power of atterny to do so legally. So its not theft but more like a DFAS error and a dumb person who didnt question the source he had no obligation to question, previded he even looked at the trasaction or maybe just looked at the blance only. So i see him maybe being told to pay it back at most. Or setlement.

I'm going to need more information on this. Maybe the Texas man was listed as a beneficiary in his Uncle's will??? Theft of federal funds: Once they are deposited into a recipient's account, are they still considered federal funds??? Did the Uncle have any other surviving beneficiaries listed as POA or listed in his will??? Maybe the Texas man was executor of his Uncle's estate. Maybe the Texas man distributed the "federal funds" to the beneficiaries??? Need more info...

Somebody failed to notify the proper authorities to terminate his payments. Yes, it is considered theft of federal funds because once his uncle died it was no longer owed to him. When someone getting a federal pension, whether military or social security passes the government will come after any money they have paid out that is not due to the estate. The guy knew full well what he was doing, even if there were any sort of payments due to beneficiaries the payments would have been in their name, not the deceased's name. Do you know how military retirement works? SBP?

Few years back all retries had to report to prove they were alive. Appeared some wives of retires were still receiving their husbands retirement check. They had a joint account an his death was not reported. This mostly wives living in foreign countries. Anyone else remember that?
