Thanks for sharing the four elements which need to be "clearly proven" for a claim SFC Joe S. Davis Jr., MSM, DSL:
1) Make sure you have qualifying service and eligibility as a veteran
2) Know the five paths to service connection [you need to purchase a subscription from veteranslawblog.org/products to get the "free ebook" which explains the who, what, why and how:
* Direct Service Connection (2 Paths)
* Secondary Service Connection
* Service Connection by Aggravation
* Service Connection by Legal Presumption
* Service Connection due to VA Medical Negligence
3) Take the mystery out of the impairment rating
4) Fight for the correct effective date
The hyperlink provides additional "clarifying" information:
#1: Do you have a currently diagnosed medical condition?
#2: Can you prove an event occurred during your military service?
#3: Once you establish #1 and #2, you will need to show that there is a legal “nexus”.
Nexus is not cause and effect. Nexus simply means that there is a relationship between your in-service event and the currently diagnosed medical condition. A bridge, if you want to think of it that way. A bridge that connects 2 pieces of “terrain”: an incident in-service and a current disability, condition, illness, etc.
You also need patience because it may take years to have the VBA act on your claim and update your disabilities and rating. I have been treated by the VA since 2013 and all of my treatment and increases in disability have been documented by the treatment side. This has not helped much yet.
In God's timing I know the VA will rule in my favor. Patience is one of the fruits of the Holy Spirit.
As long as I am connected to Christ, God is producing fruit in my life.
