I think they need to stop counting when they run out of ballots that made it on time. In the case of mail-in's, if it was in the possession of USPS or APO on the 3rd count it. After the 3rd too bad, so sad.

The laws have been consistently clear. There are states that say it must be received by Nov 3rd and there are states that say it has to be postmarked NLT Nov 3rd. There’s no law that says those qualified ballots can’t be counted after Nov 3rd or within a few days of polls closing. He’s making it up and hopes his judges will be political activists on this subject.

Yes. His argument was the lower court federal judge can’t extend when ballots are received regardless of the pandemic conditions. However his opinion also stated that ballot counting in general should end on election night or shortly thereafter; thus, implying there should be a strict timeline on how long a state should still keep counting qualified ballots regardless that state’s laws. He later tried to walk back his statement insisting we should follow the state’s laws on elections. Note Kavanaugh and Barrett were part of legal counsel that argued for the FL recount to be stopped in 2000 election.
