You know, I have to wonder....
The law in most states is that the driver of the vehicle is responsible for the vehicle and its contents. Unless another occupant speaks and claims ownership, and contraband - weapons, drugs, etc. - are assumed to be the property of the driver and the driver gets charges. If the driver is also the owner, this is doubly reinforced.
So...... with these Uber drivers having drugs in lost and found. I wonder if a cop pulls them over, how likely a claim of "it was left by my passenger" would be to be successful?
I mean, it seems pretty crappy to charge that Uber driver. But at the same time, if you do not apply that law equally, pretty soon every drug mule is going to be an off duty Uber or Lyft driver.
Yet another ethical and legal conundrum for the ride share community.
Anyone have any insight? LEOs? Lawyers? Judges?
