I have handed in a DD-368 form about 6 months ago to make the switch to go active duty from the guard, i ETS this coming January and the joint chief of staff of Massachusetts has to review my paper work to approve it or not, i had to re write my memo because it needed to be more detailed, but other than that my readiness NCO told me that JCOS is being very strict on allowing soldiers in the state to switch over. He recommended that i re-enlist for a 1 year contract to give myself more time to get approved, or wait once I am out for 6 months to receive my equivalent to a DD-214 to just re enlist to active army that way, does anyone have any recommendation on what the hell i do? I'm not a bad soldier or have been flagged for anything since i have been in for 3 years. Im lost on what i should do , re enlist for 1 year and give it more time, or wait the time period once im out for my DD214, any words of advice would help me alot, thank you very much

After the new year in October. You should be able to switch. It's a numbers game. And each state should have their end strength. A good recruiter should be able to get it done

update: contacted a new recruiter whos an e8 and he told me that hed help me out because my current recruiter honestly doesnt know what to do, he said hes making phone calls to get my 368 approved but worse comes to worse i just ETS and get IRR and go active easily no problem, he also stated my unit has been lying by saying my 368 is at the state because after 6 months the form expires, shouldve went through this nco a while ago.

If your Recruiter is willing to go to bat for you, his/her Commander can give a call to attempt to see what Officer Magic they can work. The reality of the situation is...there is no obligation on behalf of your Commander to release you. Mass Guard needs people, you signed up for them, and if they're short...well, you're stuck.

That said. If you do finish your contract and ETS...you don't really leave, you're transferred to the ING, where no Recruiter can touch you. I say again, because it bears repeating: If you wind up in the ING, you cannot go Active until you're done with that time. Which is...a long time, as you know.

It's a bad situation to wind up in. Call your Recruiter, at the start of the duty day, and see what he/she can do for you.

You don't go into the ING for the balance of your reserve obligation. This young Soldier has three years in, he'll go to the IRR for the balance of his commitment, which is five more years. ING is by request for things like family issues, medical issues, going through a police academy, that kind of thing. Basically your unit has to agree to carry you on their UMR(you're still holding a slot) and any time you miss gets added to your obligation. And to the OP, I would get your CDR/1SG involved. Retention is especially bad this year, but if there's a compelling reason(no job on the civilian side, etc.) they should go to bat for you. Once the new FY starts(1OCT), you may have better luck.

1SG, does this vary by state? The state I'm currently in does this to soldiers quite often, much to our frustration.

1SG Joseph Yorski, MHS - 1SG, unfortunately the way everything looks im going to ETS and then go active duty, my recruiter (new one i contacted) told me he can get me out of the IRR and ill receive my NGB22 and go from there, thank you for your advice and guidance, i greatly appreciate it alot!

Only problem with that is it may be some time for you to get your 22. Some states(who shall not be named) keep folks on the rolls after they ETS to inflate their numbers. I know of a number of folks who retired/ETS’d months ago and will not be discharged/transferred to the IRR/Retired Reserve until after 10/, when the new FY starts(and the new recruiting/retention mission starts.
