Over 13 months since I was forced to ETS with a RE-4 code and I was indef, What happens when they kick that ncoer out? Do I return to service? Do my indef contract mean anything? The rater, sr rater and the correct by the regulation sr rater all wrote support statements saying the sr rater only saw me at best once every other month and the rating was too harsh, Why di I feel like I failed?

No. You will not be automatically reinstated. The RE code of 4 means that your service is done permanently. No waivers authorized. If you were unable to be retained at the time of the retention board, you have no chances. I will be very interested in finding out if indeed the NCOER gets pulled from the record now that you are out of the service.

The guy at ARBA said if it is removed I will be granted continued service and as if nothing happened so if I'm out at 16 years and take them 3 years to complete the case and I'm out then I would be backpayed or just retired because ARBA has the power to do everything, So I'm definitely praying and at this point retirement is great for me.

Let me ask you; why did you wait until you were QMP to challenge the NCOER? It didn't matter back then in '11? Why didn't you challenge the QMP or QSP results when you got the notice? I just find it hard to believe that all of the sudden all the witnesses changed their mind and today the are writing in your behalf. How come back in '11 this didn't happen?

Because it was a bump in the road, I had some personal issues going on at the time and I didn't think I would be getting kicked out 5 years later because of that, I should have fought it then and it would have been kicked out back then in no time, Ok why I was not elected to be qmp from 2011 to 2016? I can tell you why I was kicked out it was because of the drawdown, which is bullcrap, I have no other negative issues in my record but a ncoer that's over 5 years old, The reason why they wrote on my behalf is because I asked, A SSG word can't hold much weight against a Major so I didn't argue with him because he told me he can kick me out

One thing that's being missed is how the ARBA, Navy BCNR, etc. function, what they can and cannot do, and why. In general, they have the authority to step in and address "egregious error". So that's a pretty high threshold in which most don't pass muster. I've been around a number of cases. If the personnel management policies and processes were followed, where's the egregious error? These boards don't deal with subjective. I'm personally familiar with evals which were appealed, the reporting senior corrected them, and then the SM was still not promoted, was discharged, etc. The Board does take a look at whether or not the "after" (presuming egregious error) record would result in the same outcome, but go there only if it's a slam dunk.
There is also a large misconception of what NOCERs, FITREPS, Evals, etc. are for. Most think it's a report about you. That's half true. The aspect that's missed is the report is also about doing something to you. Good leadership figures out what 1/3rd they want to push forward, the 1/3rd they don't want to harm this cycle, and the 1/3rd that get harmed but creates the room for the upper 2/3rds. So reports are written/edited to meet the result desired. Reporting seniors only have so many silver bullets, hence have to impose a spread. In my commands, I made sure we "stacked/packed" everyone with input from the CoC, SEL, senior NCOs, etc. Writers/reviewers knew what target they were writing to. Then when it came time for the sit down with the SM, I insisted they are told what 1/3rd they're in, why, and what handful of things make the difference. No confusion. Yes some hated it, but I always had the highest promotion rate of my people going to boards.

Thanks, I hope they are fair in their decision because it was injustice, How can people rule out 16 years of someone career and leave them without anything but these new Soldiers come in and a couple years later Med Boarded and I get nothing, I don't understand it but I included some issues below why I think I will win my case.
The issues are:
1. 4-2 rating ( a 4 for SSG performance) but (a 2 as SFC performance/ promotion potential) How is that possible?
2. Send to BNCOC once army weight control standards are met ( I completed BNCOC in July 2008)
3. Does not meet Senior Rater criteria.
4. support letters from my rater a sfc and a cw5 (who should've been my senior rater) both speak of the rating being too harsh and he barely saw me at best once every other month
5. He wasn't my rater the sfc rater, My rating chain should've went like this: the sfc (airfield ncoic) wrote my ncoer, the cw5 (airfield oic) and then the Major as the reviewer,

The Rating System is not perfect! CAPT Kevin Ball, PE-post lays it out perfectly! The report card is designed to move folks forward or backward! Usually, they don't say this face to face to the soldier! But, they are thinking about influencing the outcome or impact based of how they perceive you!
