Ever heard of Undue Command Influence.....defense counsel could use this in an appeal if he should face a courts martial....I respect your service but this is not smart Mr. McCain.

Sgt Tom Cunnally Absolutely. But the process needs to go without politicians influencing it one way or the other. That means the President or the Senator.

Senator McCain doesn't know there is any actual influence from the Executive, and is getting his information second hand like the rest of us. To come out before the process is completed and threaten action based on an incomplete picture actually "taints" the process.

If it was working as expected, and Sgt Bergdahl was going to General CM anyways, the Defense now has a VERY valid complaint. If he wasn't going, and but ends up there it's a Valid and REAL complaint. Remember, we are talking about two separate issues, one is his actual status, and the other is outsiders ability to influence the process, even perceptually.

Sgt Aaron Kennedy, MS - This process has already been tainted. No way in hell should this have been dragged out this long, the investigations were jokes to have taken so long... The only reason this could have been held up for this long is because of politics. The only question is who held it up...

SFC Everett Oliver If the process is already tainted, then there is no "fair trial" and he walks regardless of whether it was unfair for, or unfair against.

Or. The process has been delayed for things like Debrieifing, Medical, Bureaucracy, Legal, etc. Look at the some of the other high profile CM cases from OIF/OEF. They take a LONG time. Heck, look at the OJ Simpson case. That took 6~ months to go to trial, and took 11 months to conclude. And they weren't using evidence from 5 years in the past.

The military court system is the best in the world. No matter what McCain or Trump "Wants", They will get what they get and they have zero influence in there.

I was in Paktika when this guy went missing and we were looking for him, just like everybody else. He put an a lot of people in danger looking for him. I hope the courts take all that into consideration when they decide his fate.
