Yes.
Your current unit of assignment is the one that has authority for advancements. If the previous company commander did not follow through until after you were reassigned, then it is up to the gaining unit.

Thank you for your response, 1SG! There was a slight confusion because the waiver was already counted against the previous unit. It seemed unfair for the soldier because the DA4187 was given but the promotion was denied due to the late signature. ;(

SGT (Join to see) - It is a bit unfair. For what is worth, see if you can get your FLL in contact with your former CO, and see if he can't communicate directly with the new one and work this out.
Obviously the last commander saw something in you if he wanted to advance you early. Maybe he would be willing to put in a good word for you.

Yes, sir. A soldier has been given a waiver by the previous command (AAA dated April) and had a DA4187 waiver effective May 1st. However, due to the previous unit's battalion commander being in the field, the form was signed after the effective date (May 15th) which was after the soldier already got to the current unit.

That sux! A prime example of not taking care of a Soldier in my book! A good Combat S-1 or XO would have gotten that signature by the due date! Good question for current SMS thanks for asking PFC Emily Coyle

New Commands don't have to honor a thing or recognize old command decisions, recommendations etc. Current Unit will make all decisions. Original question answered is if the "effective date" of promotion is before the Soldier reported to the gaining unit and the Soldier brings the signed 4187 to the gaining units S-1. It's a matter of updating the promotion on the ERB and distributing to finance. There is no decision the new command has to make because its backdated career records. This is why I miss the PSB!!!! checks and balances are vital to our Army.

My advice is to go to the AG office and ask the experts. If your arguement is supported by them be sure to get the regulation information including paragraph and line.
