Denied an extended annual NCOER; how would you handle it?

I have an NCO who qualified for an extended annual NCOER but even after pulling out the Regs we were forced into writing an annual NCOER for him. That left him with only 9 months of rated time. The kicker is not the rated/unrated time. It is that the very same situation is happening again with another NCO and they are granting him the extended annual. I asked one of the parties why this happened and basically got a shoulder shrug saying they know I was right. Should that NCO utilize the open door policy and go right to the source or just 'shrug it off'? The NCOER was very strong but its upsetting to him and me because it feels like we were treated unfairly when there is a regulation backing us with the right way to do things.

Without all the details surrounding the evaluation my advice would be to talk to your S-1 NCOIC and have them talk to the CSM concerning the situation. The CSM should be all over this, he/she should be looking at all NCOERs before they are signed. If all else fails you can always use the appeals process, unfortunately you could end up with nonrated time for the the entire rating period going that route.

Without divulging too much, the Soldier was TDY enroute. His thru date was not 90 days prior to him clearning and then he went to school, after school he took 30 days of leave prior to reporting to the unit. His thru date was roughly 6 months after reporting here. We do not want to use the appeals process I guess it is mainly to get the answer why or find out if it was even brought to the CSM's attention. I firmly do not believe it was because we all know that if a CSM sees it in black and white with no room for interpretation then it has to be done that way. Not saying there aren't shady people out there but I don't believe this CSM is that kind of person. Oh and our S-1 NCOIC is new and apparently the one who got it changed for everyone else and due to the size of our unit the NCOIC is all we have.

That's an extended annual with the proper nonrated codes all day long. Not really sure how the annual would be justified with dates not matching? HRC will not process the evaluation if the dates do not match and it will show up on the CSM's radar anyway. I still think your best bet is to get the S-1 NCOIC involved. As a CSM I always leaned heavily on my S-1 to keep me straight.

First, find out why. Then make sure it is a reason that is in accordance with the regulation.

Unfortunately I have had little success undoing what has already been done without causing a big stir, people do not like to revisit an issue once they feel that it has been put to bed. My experience with NCOER's and encountering problem such as this is that either you gain advocates for doing what's right or you get the cold should as you have already experienced. Personally I would opt for what is right and just but know when to say you have done all that you can do without angering people with your tenacity. Best of Luck
