The example they give in the article - about the blueberries - sounds like outright theft, blackmail ... And it sounds more like something organized crime might do, not the U.S. government. I had no idea this was going on. Wow.

This practice is clearly unconstitutional as it ignores the concept of due process, and the presumption of innocence.

Criminals should not be able to "profit" from crime. I don't think anyone really disagrees with that concept. However the major problem is that Prosecutors have been perverting that concept and going after private property which "might be related to" crime.

There are cases where professional gamblers are pulled over driving through states, and had their winnings confiscated by local municipalities without any sort of judicial oversight. There have been countless cases of homes being taken in PA, because a drug deal might have happened there.

Civil forfeiture, if used correctly, with proper judicial oversight could be a good tool. However, if used incorrectly.... is a flagrant abuse of power. Unfortunately, correct usage & proper oversight are two things that are really hard to come by in government organizations.

The problem is absolute authority where thr benefits of abuse are supported by the very practice creates a dilemma. With no accountability, questions will linger.

MAJ (Join to see) You are 100% correct. I look at this like I look at the Death Penalty. In theory both are great tools that the government should have at their disposal. In practice, neither are tools that the government can be reasonably trusted with, because of the level of abuse the government has historically shown with their use of Power.

Absolutely. If you have under gone budget cuts and you have a quote, you see drug trafficking, would you know if one of those shaddy sorts passing through was innocent.
