Waving american flag graphics 4 1
Yesterday my American Legion post donated a U. S. Flag to a local organization that had just erected a flag pole. When it came time strike the colors it was found that someone had stolen the flag.

According to LEO, this is only a misdemeanor so will probably never get resolved unless someone steps up with information.

How does that sound to all y'all?
Should flag theft become a felony?
Or is it free speech?
Or just a common misdemeanor?

It's not "just" a misdemeanor, but it is a misdemeanor, because of the 'dollar' value of the item stolen, rather than the 'total' value.

Although the circumstances are special, that doesn't make them legally significant.

We have to separate emotion from the crime. The crime is a theft of an item, with a low dollar value, which makes it a misdemeanor.

It certainly isn't free speech: That flag belonged to another party.
