I have been battling my S1 to get my DOR changed for 9 months. I served Jun 2017 - Jul 2019 separated with a Chpt 18. I re-enlisted in June 2021. My ERB showed my PFC DOR as 20210601 when it should actually be 20180601. I did a 1506 with the career counselor to correct my BASD on my ERB but my PFC DOR still reflects 20210601. I have since promoted to SPC, I am wondering if there’s a regulation or if someone can give my guidance to get my SPC DOR backdated to 20210601 since I had met the requirements to promote. My BASD changed from 20170604 to 20190413 essentially shifting right two years because of my break in service.

The regulation is before. Your time out of the Army doesn't count towards your Date of Rank. If I am reading this right you would have to credit for the length of your rank before you got out. If you were a PFC for a year before you separated then you get that back. Your correct date of rank should be 20200501 for PFC. They would be able to adjust your date of rank for PFC but they can't adjust your promotion date for SPC. You BASD does shift when you have a break but it doesn't realign your promotions. I have two breaks and some time in the Guard before I came back to the RA. You are now a SPC and that date will stay in place and can't, by regulation, be adjusted. I am sure thats not what you wanted to hear.

b. On subsequent enlistment/reenlistment—
(2) With a break in military Service of more than 90 days and reenlists in the—
(a) RA—the DOR of the enlistment grade is the date preceding the reenlistment date by a period equal to the length of time previously served in the RA in the same or higher grade than that in which reenlisted. Service performed prior to reduction to a pay grade lower than that in which a Soldier reenlists is not creditable.

Thank you sir. Not sure if this clears anything up, but if I had served 2 years on my first contract and fit the criteria for promotion to SPC but was flagged. Once re-entering active duty and the flag is gone wouldn’t I auto populate to SPC effective 20210601 since I had TIS and TIG as a PFC? What I believe my BTN S1 did is a waiver, because I was promoted to SPC six months after re-enlisting.

SPC (Join to see) no you wouldn’t because of that break in service they don’t just count that towards new service for rank and promotions just towards total time for retirement!
