Am I justified to mark the 'Not Qualified' block on a NCOER as the Senior Rater?

Army Reserves
I have a SGT-E5 in my section that has not been participating in BDA's since I taken over as the S2 OIC last year (I have been the Assistant S2 for several years before taking over). He was a OK soldier when I was the S2A and did one good thing in the past. But since his COR with me hes has not participated with in any unit BDA's but has "RST" with a unit that is several states away.
-His NCOER is 6 Months over due.
-Solider refuses to send his rater and myself a NCO Support Form.
-He hasn't passed a APFT or showed improvement in wanting to pass since becoming his senior rater.
-Refuses to get a HT/WT done at the other unit he is RSTing with.
-This soldier is RED all across the board.
-Soldier also refuses to sign any NCOER.
The issue I'm having is that the SM has no Counselling Statements in regards to any of this from his first line leader...
The soldier is not even attempting to work with me or his rater. The unit he is "RST" with WILL NOT accept him as a unit transfer, as he is putting in a MEB packet.
At this point I want to mark his NCOER as a 'Not Qualified' and send it on it's way. Am I justified to mark him as an 'Not qualified" as the senior rater?

There is a lot of things to consider here! I will try and address what I do know.
Why is his NCOER overdue? This is not the SM's fault, in that I mean the NCOER can be signed even when the SM refuses to do some themselves. Just check the refuses to sign box and submit. The SM is only partially responsible for the support form. The senior rater and rater have their own responsibilities and if the SM is not being counselled quarterly this is not inline with regulation. You as the rater should have the required information to conduct the required counselling on the support form. Anything the SM does not give you can be annotated on each respective form.
As far as the NCOER being submitted, I would ensure that all of your bases are covered and submit the NCOER. Make sure you are conducting counseling and if counseling was not conducted you have to leave the dates blank and put in the comments what the disconnect was. When it comes to putting did not meet the standard the Army says...“DID NOT MEET STANDARD” is defined as a rated NCO who fails to meet or maintain the required Army standards and organizational goals of leader competencies and attributes." I mention this because there is usually a direct correlation between not meeting the standard and being considered not qualified. The Rater and Senior Rater should be somewhat on the same page (the Reviewer will ensure this if the SR is not a Captain or higher). Army guidance says "If the rated NCO’s potential is below the majority of NCOs in the senior rater’s population, then the senior rater will place an “X” in the “NOT QUALIFIED” box. This box check identifies NCOs who do not demonstrate potential for promotion, recommend separation." AR/DAPAM 623-3 will give you the no crap on all of these problems.
Summary of my thoughts!
-His NCOER is 6 Months over due- No excuse, as a SR/Rater get this done and sumbit.
-Solider refuses to send his rater and myself a NCO Support Form.- See above
-He hasn't passed a APFT or showed improvement in wanting to pass since becoming his senior rater.- Is the Soldier flagged? This is ammo for your not qualified/did not meet standard unless a profile prevented him from taking it. Can still be flagged if it was before the profile was initiated.
-Refuses to get a HT/WT done at the other unit he is RSTing with. This is not an option, get with the 1SG/CSM of the unit he is with and get this done (same w/ the APFT if not on profile).
-This soldier is RED all across the board.- Are we talking MEDPROS/HR Metrics here? Again, contact the 1SG/CSM he is attached to.
-Soldier also refuses to sign any NCOER- Does not matter, check refuses to sign and move on.

Thank you all that had responded; After a lengthy discussion with my Ops SGM / acting CSM, we were able to get ahold of said soldier.. Long story short, I'm giving the Soldier one chance to fix this mess with the understanding before that I became the section OIC, he had issues in the past with the previously Command Chain & NCO Support channels.

If it is your professional opinion he is not qualified then you should mark him not qualified. It seems you already have some good bullet comments. Remember, there is no regulation which says all comments on a NCOER have to be positive or neutral.
