At what moment does the US military separate itself from the government when thinking the Soldiers creed and oath of enlistment ?

Is there a moment where the US armed forces not partake in decisions made by congress when things get to political? What if they are wanting actions to occur by our military when they go against the people and the constitution? Is it even the us military anymore at that point? Question stems from an uncertain near future with the new “leadership” that we now have. Just asking out of curiosity

People ijn uniform do not get to choose policies or the elected officials who make those policies. They carry out the lawful orders that they receive. The political authorities need to exercise more control over who runs the military, and reaching down to the E-6 level is part of the housecleaning that is desperately needed. The vertebrae need to be brought into alignment, lest we continue to have cancers in the rank and file such as the 82nd Raceborne.

You are asking now? Did it occur to you to ask when the POTUS had privately translated talks? When he ignored the Emoluments Clause? How about when his (totally unqualified) family members were put in key positions? Jared "overlooked" more than twenty facts on his clearance review/s. Moreover, I feel your pain with regards to the divisiveness currently tearing this country apart. The Democrats used this as a political ploy to gain power; and the problem is that it worked.
I will tell you a little secret; I wanted the Senate to convict President Trump. Shocked? Please let me tell you why. If President Trump had been convicted, then a legal threshold for conviction would have been established. (Currently, a legal threshold for incitement, or in the case of Congress, impeachment, has already been established.) This SAME threshold could then be used against numerous currently-serving Democrats; most importantly, the current VP, who's encouragement of the BLM violence (you remember what she said) was even more egregious than what they claim President Trump said.
On top of this, even if President Trump had been convicted in the Senate, it would be quite possible for him to have taken the Senate's action to the Supreme Court and have the SCOTUS reverse the action and vacate the conviction due to lack of authority do to so. You recall that Justice Roberts (the Chief Justice) refused to take part. Easy-peasy. Trump wins back his innocence and Congress still gets it.
With all this said, if you really want these things to happen (I refer to your comments as well as mine) then the Congress needs to be turned. That can happen only in the 2022 Mid Term Elections. Let's give both chambers a Republican Majority. In fact, let's give them a super-majority, so that they can clean both houses.

Unfortunately, without knowledge of what it is you are either defending or being asked to do, if it is not a lawful order, then you become no better than a mercinary or the East German Stassi. Knowledge of our constitution and what is lawful is paramount, not only for a soldier in the ranks, but for your superiors and their superiors. As a warfighter, not only the Constitution is a driving force, but so are the articles of the Geneva Convention and which articles the US has agreed to abide by. In addition, the ROE as set for the AOR are also a driving force, but they must adhere to the Rules of War and our Constitution. Remember, when you are using force against another individual and take his life, you as a warefighter, are acting as an agent of the United States and not as an individual. This is why the US did not agree to article 85 of the Geneva Convention which stated that a warfighter could be tried as a war criminal. You are not a war criminal if you are executing a lawful order of a recognized sovereign state. The Soviet Union portended that all fighting elements against a Soviet element was a war criminal.

SPC Edward Abney - As members of the Department of Defense, we are required to accomplish certain training. I am a member of the Acquisition Corps, and have to take a number of on-line courses. Also, there is a set of Ancillary Training that many of us have to accomplish. Law Of Armed Conflict is one of the, for example. Another is Awareness of Terrorism, and another example is Cybersecurity.
So, why not include training on the Constitution, and what it entails? This would help fill this apparent void in servicemember's knowledge.
As far as Article 85 of the Geneva Convention, I understand it the US will almost literally go to war if the International Criminal Court (an arm of the UN) attempts to try any US Servicemember for any alleged war crime.
