Can a Soldier be chaptered out for wanting to x-fer from a flight company to a maintenance Co if he has a down slip and can't fly?

Being threatened with being tossed out for wanting to go to delta, he can't fly and was pulled aside and told that the only reason that they won't consider transferring is that he has responsibility of too many additional duties (9) for them to consider letting him go and if he tries it will go bad for him. Can they do this?

No. Out of all the battles I have had with the army, this sounds too easy and straight forward. MOS is your primary concern outside a combat zone. This person must contact the IG but there needs to be some evidence or at least make a sworn statement.
There are many ways you can chapter, and there is a big book. A rogue commander can chapter à soldier because his attitude shows lack of motivation. Literally. I came across a lot while studying regs and UCMJ. Get ahead of the wave and visit the IG. The stigma is hype, and it's your own responsibility to cultivate your career.

Being threatened with a chapter doesn't seem legit without a good reason. You're not really giving much to base an answer on.
What's the SMs reason for not having an upslip? What are the additional duties? Is the SM a FI or SI? ALSE? Those all require additional schooling and are critical to a flight company. It would be understandable if the flight company didn't want to let one of their FIs, their SI or their ALSE guy go. To threaten with a chapter seems like a no-go without misconduct or medical issues.

SM isn't FI or SI, he is ALSE, Arms room, Master Driver, Field Sanitation, TMDE and a few others that I can't remember offhand. He lost his upslip for medical reasons, and it doesn't look like he will get it back. The thing is, there is a number of NCO's that are in Delta Co that have the same school qualifications and want to fly but there is no room in flight companies. It just seems like scare tactics but I can't figure out if it holds water or not.

It sounds like the problem is that a flight company now has a grounded soldier that is qualified to perform a number of functions that take flight time away from crew chiefs. Not having to worry about working around those things makes flight schedules easier to put together.

I would say if the SM is not flagged for anything then no. Since SM has a down slip and unable to fly they are not refusing duty. I would say to use the open door policy but the SM most likely would need to move to a sister unit incase of any retaliation. All the commander can really do is deny SMs transfer request and make their life hell. If the commander pushes for a chapter it will be reviewed by jag and at that point the SM will be granted a jag lawyer to contest the chapter if they choose.
