Can a soldier who is begining the Med board process be flagged under 600-9 and be forced out before his MEB is done?

I have never seen this before personally and am unsure about the process. A friend of mine has begun the MEB process for a host of serious reasons. However these problems and profile resulted in a body state that... is well... seriously large. It is very unlikely that he will be able to lose weight at all while on this profile. What is the regulatory guidelines for flagging soldiers and putting them out while they are in the MEB process? Are they protected?

SGT Hershman,<br><br>The Soldier should still be enrolled in the ABCP, and flagged IAW 600-9; however, they cannot separate him from the service for it while his MEB is being processed, and discharge resulting from the MEB would take precedence over other reasons. Having a profile does not exempt you from from the standard, there are other ways of maintaining body composition.<br>

That is correct SSG Robida. I worked as a WTB squad Leader and that was the standard enforced under AR 600-9 if I recall the section it read something like " pregnant, recently gave birth or missing limbs, WTB Soldiers are not exempt from the 600-9". So just because you are going to a medical board that doesn't mean you are to disregard the standard while waiting for your condition to be evaluated. A lot of the Soldiers pending medical boards focus too much on the profile part that states what they can't do instead of receiving a workout and nutrition programs from the Physical or Occupational Therapists and the nutritionist that outlines the things they can do while on profile to include their diets.

Yes, the ABCP includes the opportunity to document medical reasons for being out of compliance with 600-9

No. Directly quoted from the regulation, "Except in separation actions under chapter 10 and as provided in para 1–33b, disposition through medical channels takes precedence over administrative separation processing." MEB takes precedence over just about everything else. AR 635-200 Active Duty Enlisted Administrative Separations

Yeah but when a soldier starts to fake an injury to get the MEB processes started. During the MEB process and profiles you can still eat right and lose weight. The medical condition is eating to much food most of the time.

Unfortunately admin takes precedent. In the army it happen to me but i filed abcmr for correction. How it goes is if admin starts first the infractio must be the cause of the medical problem(s). Then you have to per regs appeal to the general for over ride to continue meb. Now weight may be a different story because either one or two things if weight is due to a medical problem like thyroid yes if because of laziness it will be denied and admin discgarge. The weigh thing happened to my sgt he lost his medical retirement.
