14-12c is MAJOR misconduct. This is DUI/ Sexual Assault territory here. Sincerely doubt it, and one should hope not...

CPL(P) (Anonymous) - The characterization of discharge would seem to disagree. He did something pretty serious to have multiple levels of commanders and JAG give him the boot under that subsection... I suspect there's more to the story.

SFC Michael Hasbun I have all paperwork stating that what I'm saying is true. Everything that I had done is in writing and in my possession. I can easily prove I am not sugar coating my self or my discharge..

civilian authorities or a pattern of conduct prejudicial to good order and discipline. (paragraph 14-12b); or. (3) The soldier commits a single act of "serious misconduct" (paragraph 14-12c) "serious misconduct" is an offense which could be punished by a punitive discharge under the UCMJ. 2.

So what was the serious offense according to the type of discharge you could’ve spent time in confinement also with this type of discharge your RE Code would be a 4 which means permanent disqualification for Military Service

As posted by another member, waiverable, but whether it would be waivers is a question for a Recruiter.

Don’t want to come across as an asshole but, what did you do to get discharged for misconduct and what made you change you mind about staying in the army? RE-3 isn’t impossible to get a wavier but you have to show the full bird colonel who signs off on the wavier you won’t be a bad apple so to speak.

Scott Hitchcock hmm, I’m not sure if you’ll be able to get a wavier for that, granted I’m not a recruiter. All I can say is when you get time or completely out of the army. Which I believe you are not sure just go to a recruiter with your discharge packet and see what they can do. Best of luck

Can I reenlist into the Army after being discharged for misconduct?

Would depend highly on the nature of discharge and reentry code listed on your DD214.

Difficult to answer without the RE code and the separation code. I will make a wild guess and say you have an RE CODE 4, which means that you are permanent disqualified, no waiver authorized.

What is your RE, or reentry eligibility, code? RE-4 is a permanent disqualifier. RE-2&3 require waivers.

Thanks, sir. I'm going to try and actively work with a recruiting office to see what I might be able to do.

Scott Hitchcock unlikely. You can write a letter that can be submitted with your waiver packet.

SFC (Join to see) Hi my name Is SPC Aipoalani (call me AI ) for short . But I just got kicked out the army actually with an RE CODE 3 and JKQ . I have an general discharge under honorable conditions . I got falsely accused of stealing a battle buddies debit card and made some stupid ass mistakes by swiping it without even looking at the card. Now when I got in trouble I actually was suppose to get dishonorable discharge. But then since we have security cameras in our motorpool evidence actually showed that I didn’t steal and that, that person intentionally went in my locker and place it in my wallet . He got out with false accusations and for actually setting up his own battle buddy (aka me) . But if I were you do some research in it and you can actually receiver a waiver. Everything after 2years is non existence no more

As a former background investigator on the LE side, it always comes down to the same three questions. Number one, how severe was the offense and your intent at the time? Number two, did you express remorse, and show efforts to correct the misconduct to the satisfaction of all parties? Number three, what have you done in a genuine and habitual fashion to show overcoming the prior offense? Not to discourage, however, depending on your reenlistment code and prior actions, it would be best to speak with an attorney in your area that is familiar with these kind of issues. When I am listed, I had to overcome the same question due to getting in trouble as a juvenile for theft. I had to work very hard to demonstrate how I had grown up to the recruiting board at the time. The best policy is always honesty and humbleness. I hope this helps.
