So at the gate for a random vehicle inspection. Blue vests ransack the car like we did something and the only CLOSED backpack on the back begins to be searched. The driver of the vehicle asks woah hey can he search my personal belongings, aren’t their procedures.. the blue vest got defensive and was like I didn’t touch your back (clearly he did) and if you have a problem you can file a complaint and if you lie I will take you to civil court (as if it’s that serious) the guy was like okay... he then tried to defend himself and said the backpack was open and that he had the right to search it anyways (the back pack was closed zipped) he said okay... the blue vest said he was sending up a statement to idk who he said but my questions are.... 1.) can they in fact touch your personal belongings and not have to go around them to search the open compartments they tel you to open... 2.) who did he send the statement up to and why didn’t the driver get to write a statement if there was one and what happens next.. asking for a friend cuz he doesn’t have rallypoint.

If you’re coming on to a military installation, they can search whatever they want. Your attempt to enter is your consent to be searched.

And to add, usually there is a sign in front of the Guard Post stating that you and your vehicle consent to be searched by entering the base. Think of it this way, without these powers don't you think that contraband or maybe even a bomb might attempt to be smuggled in??

Everything is subject to search upon entering post, including you if they feel it necessary.

Yes we give up some rights being in the military or entering base but we still have rights..

Probably because he was a moron, or panicked. Yes, you still have rights, but you do forfeit some on post. They can't just decide to search your car for no reason, but by classifying it as a random inspection it's legal. You can, however, file a complaint to their supervisor and if they won't listen go to the Garrison Commander.

SGT James Hinch - Actually I believe your wrong on this in that because you are entering a military installation you are possibly subject to a random search of your vehicle with no probable cause to believe a crime has been committed needed.

CSM Thomas McGarry, unless policies have changed since I got out in 2012, which is possible, that's the way is used to be.

You are subject to search as soon as you enter a military installation. Everything. Full stop. There are no "safe pockets".

Yes sir, but why did the gate guard even say they cannot search our personal belongings unless the bag was open.. once the bag is open it grants them entry.... so on here everyone is saying you have no rights and yet the gate guard even confirmed that he couldn’t touch the bag but if it was open he could. Also if it’s the case of coming onto base why is it that mps even have to have a warrant to enter and search your on base housing, our a warrant for a cell phone search through an investigation... we may be in the military but we are still entitled to certain rights... I understand the basis on the random vehicle search and no one denied the search at the gate it was just simply a question
