My son-in-law was injured by a roadside bomb in Iraq. The VA has determined he has a permanent brain injury due to the bomb. Does he receive a Purple Heart and how does he get the Army to award that?

Yes, he is eligible. This almost same situation occurred with me. I didn't receive my purple heart until 10 years afterwards. I was already out of the military so it took quite a bit of correspondence on my part, but I finally figured out the exact order in which the award must be submitted. If he is currently serving then he needs to contact the US Army Human Resources command with the appropriate paperwork and submit it. If he is no longer serving you should contact your local Veterans Service Officer rep and they, in conjunction with the Military Order of the Purple Heart will help him submit the appropriate documentation first to u.s. army Human Resources Command. If, upon review, they sent it, as they did me, then submit to the army records review board which has the final say in awarding or upgrading of military records and awards. The army records review board however will not review the case unless it has already been seen and denied first by the US Army Human Resources command. It took me approximately 2 years in this process to finally be awarded my Purple Heart for a concussion received from an IED in Iraq in 2005. The veteran did not receive a Purple Heart, believes he or she is eligible for a Purple
Heart, but military records do not reflect that he was awarded a Purple Heart. The
veteran must complete the Application for Correction of Military Record (DD Form 149, Sep
2007) and send it to:
Army Board for Correction of Military Records
1901 South Bell Street, 2nd Floor Support Division, St Louis
Arlington, VA 22202-4508
I would also include copies of all VA medical records documenting the Traumatic Brain Injury (TBI) in support of your son-in-law's request for correction of military records. Of course he should be entitled to it. There shouldn't even be a situation where anyone should question. And the soldier or his family should not have to request it. The military should be aware of soldiers that were injured in the line of duty. This should be awarded not requested

Major Ronnie Reams is correct regarding the need for medical treatment after the explosion. He is incorrect regarding the "bleeding" part of his statement. I received the Purple Heart for my injuries sustained by an instrument of the enemy which was an improvised explosive device though I never had any blood injuries. The detonation blast pick my vehicle up then set it on fire but the Halon system extinguish the fire as it should have. We were all treated in the field and medevacked Via vehicles due to the Threat Level in the environment.
The regulation does not require any shedding of blood as long as it was an instrument of the enemy twitch an improvised explosive device qualifies as.

MAJ Ronnie Reams - as a recipient of the Purple Heart, I read the regulations and requirements for this award because my initial paperwork was lost by my unit. I was treated while I was in Afghanistan and continued medical treatment in the USA. There is no requirement for the shedding of blood written into the regulation. A traumatic brain injury is still an injury despite the fact that it cannot be seen visibly on a person.

How about PTSD caused by exposure to the war zone......how many of our brother and sisters have lost their battle (22 a day?)......maybe recognition that their "injury" was related to war time service would aid in their treatment.....assuming of course they can proved the "injury is a direct result of enemy actions".........ohhh and as to bleeding....not a requirement.....know a medical who got PH for a sprained ankle (yes I said sprained ankle) that resulted when he tried to egress a HMMWV and got his foot caught on the weapon mount......anyway ......moving on.....ohh and yes I understand that issuing a PH for PTSD would open the flood gates and devalue the medal....you konw kinda like giving one for a sprained ankle.

Someone was asking in behalf of another, so there may be many reasons the asker was not aware of the criteria for the awarding of a Purple Heart. What is obvious to some isn't to all, but we can help guide whenever possible.

As far as I know, any wartime injury, or injury suffered due to combat with an enemy, deserves to awarded with the purple heart. I agree with a lot of the post here. If he has not been awarded the purple heart we should raise holy heck about it.

I have TBI and it was combat related and diagnosed through the VA and I get compensation for it. No Purple Heart. Yet I know soldiers who told the Medic how to write the report in my last deployment who claimed TBI and were awarded the Order of the Purple Heart! So it's a delicate thing. I resent those who pose and claim false awards. I don't have to explain shit! I am 100% through the VA for TBI N PTSD. I've seen severe TBI cases. Not a pretty picture! They are fucked for life! They deserve it a Purple Heart! Not these ass holes who faked a concussions had the medic write a report for them!

I'd have to say absolutely and wonder why it hadn't been awarded him yet. I read some of the posts that contain criteria for the medal. I don't see where he doesn't fit anywhere. Must be paperwork that hasn't been put in or something of that nature. I'd check into that because injury incurred certainly merits the medal.
