How can someone use a DA 4991 to delete an assignment to Fort Riley?

So here is the situation:
I am currently stationed in Korea and have 28 months left of time in service. I am a first term soldier with 18 months time in service. I have orders to Fort Riley and do not want to go, is there anything I can do? I have attended my levy briefing. I can’t find a way to access the new DA PAM 601-280 regarding signing a DA 4991. From what I understand, I am ineligible for KAIP due to me coming to Korea directly after AIT, and I believe I am ineligible for a first termer statement due to the fact that I have the required SRR. Am I also ineligible for a DCSS due to my SRR?

A DA Form 4991 is a Declination for Continued Service. As in, you are on assignment but you don't have enough time in service to meet the assignment and would have to reenlist. For example, You had been in Germany for three years, your ETS was coming up in months and came down on orders for FT Riley. But, in order to meet that obligation, you would need to re-enlist. But since you don't want to go, that is when you sign a Dec Statement. Being that you are on a hardship short tour, with so much time remaining on your contract, the Dec Statement will do you no good. The only thing you can do is contact your Branch to see if they can find you another place to go. But.....don't hold your breath.

Thank you so much for your response SFC. This gave me the peace of mind I was looking for. I think it is absolutely insane for the person who is actually in that situation to follow through, and it helps a lot to know they'd have to go through such hoops to make it happen. Have a good night!

A DCSS only declines to reenlist. A first term statement does exactly the same thing but has no negative impact. Both require the SM to have an SRR that they dont have the time left to meet. Signing a DCSS won't do anything because the Career Counselor didn't give it to them, and the Career Counselor has to process it. They aren't eligible for a DCSS so it would just go into the shredder.
The SRR for returning from Korea is 6 months. The Soldier is already on assignment so the Army will not entertain an IPCOT or FSTE for them.

If you are planning on staying in, DO NOT dec your orders. SFC Livingston is right too, you have time on your current contract to PCS. My advice is this: Take the assignment. I say this for several reasons.
1. If you plan on staying in, a Dec statement does not look good.
2. Riley isn't a bad assignment..
3. If you are getting out, ETS'ng out of a CONUS assignment is much easier and less stressful than doing it from overseas.

Let me just be straight up honest to avoid any answers about don’t be dumb. This isn’t actually my situation, its someone I know who is being very stupids situation. I want to know the likelihood of them pulling off this foolish situation.

SGT (Join to see) - Then tell your buddy to pack for Kansas summers. Again, even if the IPCOT is approved for another 12, they will still have to (more than likely) PCS to the states for the 4 months to process ETS. The only OCONUS tours (not including Hawaii or Alaska) that I know of where people can ETS in is Germany.

MSG (Join to see) - Thank you so much for the responses. I’m gonna take your first advice to enjoy some beers and jerky instead of telling them so that they don’t try and find some abstract loophole. I will just let em fool themselves into thinking they’ve got it all figured out and watch em head off to kansas where they belong!

PFC Jeffrey Herrington - Well, I just send a request to remedy that. And thank you for the congratulations. But, for arguments sake, even if the IPCOT is approved, there is still the remaining time left on contract. And let's be honest, how hard is it for Big Army to replace a PFC or SPC in Korea in comparison to an E6 or E7 (MOS depending)? Let's face it, this particular kid is heading back to the States.
