How can we get a transfer out of an RFX company after it has already been denied by a General?

My husband is in the reserves in an RFX company and I am active duty oconus. We got married Nov 2019 and he notified his chain of command of a change of location. His transfer paperwork has now taken 18 months and gone all the way up to a general only for the general to deny the transfer. I said to use the open door policy with the BN CO or BDE CO who are both tracking he flies into drill every month from oconus and ask what is going on. How can we make this transfer happen?

SPC Breen, I know at one point your husband was attempting to transfer to our unit and I never heard from him again. Please email me offline, or have him email my .mil and I will try to assist. Our unit is RFX as well and we routinely transfer Soldiers out. I recently worked a transfer for one of our Soldiers whose AC spouse PCS'd to Germany. It's all about how the letter of justification is written and getting chain of command endorsement beginning at company level.

MAJ (Join to see) Any Advice? Is he getting the $500 reimbursement for travel? I know it is not enough and what about the 14 day quarantine? You should be able to do that. I live in Canada and I can't go to my unit without worrying about a 14 day quarantine on the way back and now Canada Demands a coronavirus test upon entry or upon meeting the border agent at the airport. I think you should go to your Congressman now if the general says no.

SGT (Join to see) I am sure he could work for Pacific command and there's also an army reserve unit there. I know a friend of mine had to go almost every other day to bug his unit and his higher command to get out of a ready force unit. He was trying to get into The inactive ready reserve luckily the command was reluctant but let him go but it was a civilian who took their damn sweet time. These were the civilians at moffet that took their damn sweet time.

If the transfer has been rejected already I recommend the Congressional pathway as well.
APFT alone wont block a transfer. If it was, then a counseling statement would need to be composed. However, on the DA268 that initiated the flag action against your spouse APFT and H/W are transferable and he can move to other units. It's just about the only flag that one can still transfer with.
Now, that's not to say the receiving commander could simply not take him as policy without a current or passing DA705. It's much easier to find a new unit when the soldier is high speed, not flagged, and med pros green with strong NCOER's etc...
Just be careful where you end up. Not all units are created equal, and not all bad situations are a result of RFX. Also, full time staff, and commanders rotate out ever few years. A process that is in limbo for 18 months basically means it's totally lost. Because somewhere between the requesting soldier and the approving authority folks have transferred out and moved to different assignments. Especially if the CG is the approving authority for a company level action. Company - BN - BDE - CG somewhere in there someone has had a change of command in that time.

CPT (Join to see) - Thank you for the Nuclear Option called your Congressman. It actually helped my Father when his disability pension was being taxed by the IRS even when it was a tax-free service connected disability he received from Los Angeles County Sheriff. My Father contacted his Congressman and the IRS stopped auditing my Father and the fines stopped as well.-Yes, what about the APFT/ACFT on hold for this time being? What if the soldier requests an APFT and passes it? I have not been up to date with the HRC weekly updates. It is one thing if you want to get out but his Wife is in Hawaii now. This guy has to take 2 days off of work to make the flight. It is a hardship. 2,500 miles. This soldier is not a Captain like you. I have traveled 1600 miles from Alberta, Canada to Orange County area of California for almost 20 years but I was an Officer and I chose to move to Canada. The USAR is short-handed everywhere. The CG of he RFX unit should let him go. I hope someone in his Chain of Command is here on RP. This is not taking care of soldiers! CWO3 (Join to see) LTC Daren Walker

Sorry if this was already answered. Due to “relocation” you should only need the immediate losing commanders signature on the 4651–the packet is the forwarded to the RD. Personally, I would initiate an IG complaint for not following the packet checklist from PAG (personnel action guide). But not all Soldiers want to go that route.
