The incident I am refrencing involves exposure to a blast and I have an lod from the time without going to a TBI clinic then 3-4 years later went to the VA and had evals there. Someone brought up the topic of it and I looked at some online postings of the requirements if any, and I think I would/could fall into those. It never was something I looked into doing because I wasn't awarded.

SPC James Harsh - if you incurred a TBI then you need a personal statement and 2 separate personal statements from people who witnessed the blast. Medical treatment records from the time would help but are not required. And medical records for treatment now are needed though.

Google "retroactive purple heart tbi" and it should bring you to the HRC page that will walk you through the process.

SPC James Harsh I have a scar on my right thumb where some shrapnel hit it. It was only a surface wound. Being a door gunner and seeing the WIA's we took on board, to take to the hospital, I wasn't going to disgrace their serious wounds with a PH for me. I have arthritis in my thumb now, but it doesn't come close to the wounds I attended to after getting them on board. I have a DV license plate, but not for that. I also, don't park in Handicap spots, because I can still walk. I'm not sure I would if I couldn't walk. That's just me. Go for it if you think you deserve it.

I have been in many blasts and was never awarded the PH I had shrapnel in my mouth where a Dentists had to remove it. If you really think you deserve a PH for TBI go for it just remember the SM's that died for that award.

I did, however I'm asking about representation rather than compiling my own packet and mailing it. If that is what has to be done, that is what I did for my disability claim than so be it. I think this is something that maybe I should seek assistance with, that's all. I don't think the local VSO is going to get it done, maybe I should see I have never met them. Someone on Rallypoint had to of done it outside of service and going to HRC.

I am out of service & thinking of applying for a Purple Heart. Is there a POC to contact for help or should I just apply on my own?

This is where I have a slight issue with the Purple Heart. Soldiers that were wounded in action deserve distinction, the other side of the award is that is the metal given to families for those who weren't as fortunate as us. I was wounded in action and have TBI, one other individual in the vehicle received a Purple Heart. The rest of us decided we didn't want the award that's was given posthumously to family's along with a folded flag "from a greatful nation"......

There was someone in the vehicle who I pulled out and he survived which is good, and also was awarded a purple heart. I haven't done anything to try and apply for it. The thought arrived and if I had one it I would recognize it more for those who have sacrificed. Out of the replies the DAV seems like a good route. I have no plans on it and I know there's criticism over the newer TBI and stuff. The opinions help.

If your condition is a reflection of injuries sustained in combat then by all means go for it!! What's the worst they're going to tell you, NO? Ok then drive on. Don't ever let somebody criticize you for injuries sustained in direct combat motherfuckers have no idea what is given to receive those awards. We always referred to them as they forgot to duck metal or an enemy marksmanship award.
If you go to your local VA I'm sure there is a liaison there to guide you through the process. Good luck and keep us informed

I was awwarded a PH due to shrapnel injuries I recieved in Iraq in 2003. Though my injuries were not life threatening and I was returned to full duty a short time later. I have had some other problems related to Iraq mainly due to the shrapnel and I recieve compensation from the VA for that. But what is more important is that we need to start thinking about why we as Veterans and Service members recieve a purple heart, it is not only for those who died in combat. A purple heart is for those who are injured in combat. With medical science showing that many people are being injured internally with no physical scar to see, many people are allowing themselves to forgo proper treatment. Sad to say but seeking an award such as the PH to assist in treatment in todays world is sometimes necesary so that the serve member does not fall through the cracks.

(2) Any member of the Army who believes that they are eligible for the PH but, through unusual circumstances no award was made ,may submit an application through the member’s chain of command to Commander , H R C (AHRC–PDP–A). If the requestor has separated from the military, the application may be mailed directly to the Commander, HRC (AHRC–PDP–A). The application will include the following documentation pertaining to the wound and inflicting force:
(a) DA Form 4187 (Personnel Action).
(b) Chain of command endorsement (through the first general officer in the Soldier’s current chain of command for currently serving members).
(c) Deployment orders.
(d) DA Form 4037 (Officer Record Brief)/enlisted records brief (ERB)/DA Form 2–1 (Personnel Qualification Record).
(e) One-page narrative describing the qualifying incident and the conditions under which the member was injured or wounded.
(f) Statements from at least two individuals, other than the proposed recipient, who were personally present, observed the incident, and have direct knowledge of the event. Alternatively, other official documentation may be used to corroborate the narrative.
(g) Casualty report.
(h) SF 600 (Medical Record - Chronological Record of Medical Care).
(i) DD Form 214 (Certificate of Release or Discharge from Active Duty) (if applicable).
k. Each approved award of the PH must exhibit all of the following factors: wound, injury, or death must have been the result of circumstances described in paragraph 2–8b; the wound or injury must have required treatment, not merely examination, by a medical officer. Additionally, treatment of the wound will be documented in the Servicemember’s medical and/or health record. Award of the PH may be made for wounds treated by a medical professional other than a medical officer provided a medical officer includes a statement in the Servicemember’s medical record that the extent of the wounds were such that they would have required treatment by a medical officer if one had been available to treat them

I never talk to groups outside of official DOD but maybe I should ask someone familiar with the VA and the Federal building, that is what I am thinking. I don't know what it's called but I think there's representation available for claims so maybe that would be a good start. I didn't know if anyone has experience of doing it.
