CJ Grisham, President of Open Carry Texas, Army veteran and recent candidate for State Representative in District 55, along with a couple of other people was arrested yesterday in Olmos Park, TX (Bexar County). He was tazed and subsequently injured in that arrest with a head injury and was hospitalized. I was told that the head injury was a large gash on the back of the head. He also suffered numerous scrapes on his wrists and arms.

Grisham and crew were legally opening carrying pistols and long guns in response to an event last week when an Olmos Park police officer drew guns on and detained someone with a protest sign solely for the reason of open carrying a pistol (which turned out to be a training fake).

Grisham had a phone conversation with the Olmos Park Police Chief, Rene Valenciano about their policies, etc. in which the chief seemed entirely unconcerned with his officers illegally detaining people for a perfectly legal activity. (The conversation will be linked in the comments below).

Grisham and crew went to Olmos Park yesterday and were legally and peacefully open carrying and got arrested for it. There is a video of the arrest. There was no articulated probable cause for the arrest. The police showed up, including Chief Valenciano and ordered Grisham and his crew to the ground. Grisham at least refused. It was Valenciano that personally tazed and arrested Grisham.

Between the phone call and video from the site, it's very clear this was an illegal arrest by an oath breaking police officer and they will be held accountable.

In essence, this was a constitutional audit that Olmos Park Police department failed to a level no one imagined. They went there to expose the corruption and constitutional violations of the Olmos Park Police department. All OPPD had to do was honor their oaths. Instead, the held armed and unarmed civilians at gunpoint, assaulted two people who were neither suspected of not committing crimes, destroyed evidence (broke camera of Jim Everard), seized and kept cell phones (because of the video that was taken on them), they tazed and assualted a man who was neither a threat nor a suspect, they kidnapped a woman on a retaliation warrant that they got for "interfering" for her videotaping them harrassing someone with a sign, then that same officer that had assaulted that lady prior got caught on tape threatening to rape her when she was in back of the police car, they falsified documents, filed false charges, lied, bragged about "squashing the rebel" because they knew who they had, held other camera operators at gunpoint, and the list goes on. Not sure why you're conflicted unless you believe in backing the blue no matter how corruption the officers are. If OPPD has egg on it's face, they put it there themselves.

SPC Chris Ison - we all have the right to carry. why is the 1st amendment license free, yet the 2nd one isnt? why are all other licenses honored across state borders except for CCW? this is all about political ideology, this isnt about identifying a good or bad guy with a gun.

SGT Dan Gray - I have several grandchildren in school and I suspect that they were never taught. My grandson asked why they were not taught about the constitution and its powers . I had no answer for him and had to leave it at that. My children also stated that they got out of school AND COLLEGE without learning anything in depth about the Constitution or the Bill of Rights. SAD ! No wonder this country is so lost, a bunch of liberal (Read Communist) teachers have decided that they know better than anyone else what is good for us to know ! ! It is sad that this great nation is on the verge of total collapse and no one seems to care ! It makes me sad this is not the same nation that I spent 20 years defending in the military.

SGT Dan Gray - The constituion limits the federal governemnt not the state. And Heller v. DC says that the governemnts can limit guns based upon public health reasons.

CW3 Dick McManus - Well, Chief, Mr. Trump was hell of a lot better than the person who was running against him and her track record was really one that sucked. As usual, I went with the one that I felt I could trust more and that was the non-politician. I am the first to say he was not perfect…most of us who voted for him agree on that and most of us agree that he had his moments and his times really upset us. HOWEVER, look at all he accomplished. I am not going to run a laundry list here as you did. I am not a liberal and I am not a republican. I am an American, Independent, and conservative. I vote for the person who I feel best represents the interest of my country and me. We didn’t have another Benghazi and he di a lot for the economy, the military, and made inroads with diplomacy where it had never been made before. I think that was a plus.
I am an MST survivor and I had a choice, keep my mouth shut and have a career the military or speak up and get thrown out and have the perp promoted. Kept my mouth shut and at least the perp dint’ get promoted…I was lead to believe that he may have been ruffed up by some of my friends at a later date. I have no proof of that, though. So, I understand and know where the woman are coming from. I have been there. There was no press given to me or others who were in my situation. We just sucked it up and decades later the military still does nothing. We continue to suck it up. Why are civilian woman not trained to do the same…not that they should, but we military woman do because it is what we have to do. We have done it for decades.
I voted for Mr. Trump the second time, too. He was better than the other choice and HE HAD ACCOMPLISHED MORE THAN THE PREVIOUS 4 ADMINISTRATIONS HAD DONE.

Yes, ole Google gave you the correct answer. About 80% of women and 15% of men are raped or assaulted yearly. Your leadership skills are lacking to not have been aware of this. Did you have to wait to read about Jessica at Ft Hood to be aware of what is going on on our Army?
I am not interested in your books, gratis or not, but thank you for the offer. I spend my “spare" time as a volunteer assisting young veterans and their issues. I feel that is important as one who has been there and didn’t have to read about it in books or google.

But, "trying to win your cause in the streets never works out?" Naw, can't go with that. If there are enough people involved, and the other side doesn't use machine-guns for crowd control, it always works. The founding fathers were just people, not heroes out of legend, THEY took it to the streets opposed by the British Army, not some sad fat fucks too scared to "allow" fellow citizens the right to be armed. Having spent most of my adult life armed and in the company of other armed people, my only concern in that situation would be an ND. From the cops fiddling with their guns out of fear because their special status is being questioned in the only way that matters.

You say the democrats have never taken guns away well you had better do some reading because that is not true. I used to be a democrat several years back I would say about 25 years ago lol but I saw where they were getting more and more toward socialistic policies and away from freedom That is when I decided I was no longer a democrat and since we only have three ways to vote Republican, Democrat, or Independent(and Independent has never done anything but wasted a vote) I decided to vote for who ever represented my View the closest. At this point that happens to be Trump since Pence is against gun rights, the right to life, and the right of freedom.

I agree with you. I was never belonged to one party. I voted for the person who I thought supported my views and stance on issues that were important. Like freedom of speech, Freedom to bare arms ( But must admit I don't own any guns ) I have many times over the years since my first time voting ( I am 66 years old, started voting at 18 ) I have voted for Democrats, Republicans, Independent and even Libertarian. In the last 6 years I voted for both our my states democrat US Senators.
However there is no way in Hades, that I can vote for party, the democrats who have gone so far left, that if allowed to have control of this country, we will be the very thing I spent 20 plus years of my life serving to prevent, Communism, Marxism type Socialist government. It has not worked in any country that tried to use it, Cuba, China, the old USSR, ( even the new Russia somewhat ) Venezuela other smaller South American Countries, and even some African countries. All that happen was, just a switch of the haves and have nots. Just look at the history of China, the old soviet union, Cuba, Venezuela. Study history, after the masses helped put the communist dictators or social Marxist into power, those who gain control turned on the very masses that help theme game control. Stalin, murdered millions because he wanted ensure the same people would not turn against him. China killed and imprison, all intellectuals.
Heck look at the Obama care, yes it gave millions people free health care, well it threw many millions off health care because the couldn't afford it gave them a subpar health insurance. Bottom line, it just switches roles. Instead of in this country where any one who wants to, YES anyone, who wants to can do their dream. We have had many legal immigrants who have come here just in the last 20 years who have, and they weren't white male Americans.
I have always believed that there should be safety nets, for unemployed, the aged, at risk kids, and adults who need special help. However I am not for free handouts, limiting speech, and trying to outlaw speech just because people find it offensive, or disagrees with their ideology
The bottom line, I can't support a party ( dem) who push cancel culture, anti patriotism, uses hate to divide us into groups. So I had to #walkaway

My biggest fear, is that to many are listing to sound bits from a very bias media and Social media. I never thought I would see in this country where government agency could be use to outs an elected official, I never thought I would every have to worry about my thoughts, my oppions, love for country and my faith, could land me in jail, or worse.
I hope the Dems will come back to middle, or another party can take their place. Until then I can only vote Republican.

I am no hater of military or LE, I love them both, as I am/were both. I just don't feel the military has much leg to stand on when pointing fingers at LE to do their job.

The police crossed the line. BTW, I used to live in Bexar County and a good number of the police there are not to be trusted. I rarely say things like that, but none of us who were female, would pull over for a police officer; we would drive to the station if stopped.

Definitely some interesting viewpoints here...and valid on both sides. I personally dislike seeing a long gun open carried even though I can understand the reasoning behind it. I think that open carry of a long gun scares the firearms illiterates who VOTE and that hurts our cause. I see open carry with a sidearm frequently and nobody seems to pay much attention to it.

I can see both sides...an attack might occur where the thug doesn't know there's another firearm around...and an attack might be stymied by the sight of an open carrier. I don't think the average thug wants to use his gun...I think they simply want to brandish and scare the bejesus out of their victim and get a couple of bucks for their next drug night!

There are many police departments in Texas with similar reputations. The more isolated the community, the more likelihood there are to be problems with the local (or county) law enforcement officers.

I grew up in San Antonio and I am offended by your generalization ofthe entire law enforcement community of my home. I have family and friends in the law enforcement community and they are extremely professional . Growing up on the south side of San Antonio near lackland afb I remember how service members on leave in downtown San Antonio use to make rude racist remarks to me and my friends such as “hey how much for your sister paco?” but I did not generalize their racist demeanor to the entire military.

You are not alone, as evidenced by the attack on our Capitol. Maybe you can get a laminated card to inform LEOs that you will only obey the laws you support. Not how it works bubba, all in or all out. Maybe you will get to off a cop out of the deal, and make the big league. That would make you a force to be reckoned with for sure. I have a mouth and know how to stand up for myself. No law was broken that day, which is something you continue to fail to understand. The "world according to Grisham" is a world where constitutional rights are protected from douchebag cops and statist tyrant cops. Slippery slope for the 1SG. I am a full supporter of open carry and the 2nd amendment. I understand the state of concern in this country about the issue. However, I can relate to both sides. I will tell you that as a former law enforcement officer, its not a citizens best interest to show up to any protest armed with a gun. Especially if the protest is against the cops. If you show up in protest against cops, they are already uneasy about it, but showing up armed and throwing it in their face is just really a poor decision. As far as the police officers, of which many are veterans, they stick together much like you do in your unit. The police chief will stand by his guys until the investigation is complete. They make mistakes, and trust me they pay for them. The incident that led to this protest, well we do not know exactly what happened. We were not there. I am not saying that the police did or did not violate civil rights. We simply do not know. Let the courts handle that mans issue. The government will not get your guns without a fight. This was not your fight. I know that no one is perfect and emotions run high, but discipline instilled in us as soldiers should teach you how and when to react if at all. We do not need anymore of this anti police movement in America any longer. The job is pretty damned hard, and demands a lot of different emotions. I have caught myself chewing out a motorist for a traffic stop for a minor violation that they did not deserve. I apologized, and gave them a warning instead of citing them. The reason I was so aggravated was because of the call I had just got off of that included a deceased infant. Think about that when you just automatically assume a cop is an ass hole. I hope that the 1SG makes a speedy recovery, and I also hope that he maybe makes a better decision next time. Lead by example, our military needs it.

MAJ (Join to see) - I am not disputing that there should be some classes taught about constitutional understanding in the military. But I am disputing the question "So why do we take an oath that we intentionally don't teach about?", we go to school and in school are taught about the constitution or used to be back in the 1960's not sure what they teach now with all the BS coming from college students. But with that you have enough to understand what the constitution is about. So it is assumed by the leadership that we have a basic understanding of the constitution. I believe the question is something that should be addressed for a minority but at same time the majority should already know enough.

SPC Curtis Underwood regardless. My opinion is that the military should have the moral fiber to validate your understanding of the Constitution through a competency exam. When I Commissioned in 1998 OCS (NG program) did not teach the Constitution, was not reinforced in OBC,AOC, nor CGSC. Why?

I’m not sure how you reconcile: “It’s not in a citizen’s best interest to show up to any protest armed with a gun” exercising their rights with “discipline instilled in us as soldiers should teach you how and when to react”. If LEO’s knew the law and Constitution and were disciplined, None of these rights violations should have happened. Then you discuss an instance where you were undisciplined and chewed out a motorist for something they didn’t deserve. So just a question, How frequently does this happen that those tasked with enforcing the law don’t know the law and are undisciplined in violating citizens rights because they are uneasy about the situation?

That’s the best you can come up with is the 1SG instigated an altercation with noncompliance to an officer’s instructions, verbal harassment and disorderly conduct? This is absolute nonsense and you ought to know better. First of all, exercising your Constitutional rights ( supersedes all state and local ordinances). One cannot instigate an altercation when no law is broken and there is no probable cause. Thus, the instigation was the chief’s. (Not that I believe this is what the 1SG was doing, because I don’t, but It is not against the law to be obnoxious and it is not against the law in Texas to open carry and I don’t give a damn if some podunk chief of police in some podunk drive through hamlet doesn’t like it. He doesn’t get veto power over state law or the Constitution. Secondly, an officer’s instructions are not gospel any more than an order that you make to a subordinate would be lawful if say you ordered your PSG to assault his squad leaders. Verbal harassment, huh? Well that one is protected by the First amendment, still protected, still not a violation of law. You seem to have a lot of contempt for that document you swore to uphold against all enemies foreign and domestic, with emphasis here on domestic. Disorderly conduct would get thrown out of court also because the chief and his officers had no business even approaching someone not breaking the law and against whom they had no probable cause. That boomerang will come back on them as false arrest, and assault and brings me back to how on earth can someone enforce the law when they don’t know what it is or don’t understand it? Keep fighting 1SG. You are legally correct in all areas.

What we have is one side of the story. If the police show up and give you instructions to get on the ground, I recommend doing it. You do not know what information they may have been given. With about 40 police officers murdered this year, I am sure they were nervous around a group of armed persons that they did not know the intentions of. I have done this job for 25 years and I have no intention of being murdered. I really dont give a shit about your particular cause which is making you perform provocative actions. I am going home at the end of the shift. If you carry a weapon, use common sense. I would expect a former first sergeant to be a responsible adult. I support the second amendment. But with every right comes responsibility.

Bob you sound like the problem. You have a badge, that gives you the right to do what ever the fuck you want. I have no doubts you are the asshole cop speeding, texting while driving, failing to signal, blocking traffic et al. Retire, your self righteousness will end badly.

MAJ (Join to see) - wow, sir. Not sure where you get he is in law enforce officer. However I am glad I am retired and don't have you as a commander. So the best way to get your point across was to attack the Major and his character? This is happening to much by everyone. I see nothing wrong with his statement. You follow orders given to you by those who are in charge. Your an officer, what if you gave one your young troops a order, and dismayed you?
The Major was pointing out the facts, we weren't there we are only seeing part of the situation. Not what happen before. He is right there have been way to many police officers killed in the line of duty this year, hell of lot more, then people who the media want to try use to demonize the all of law enforcement.
Follow those in charge, then take it to proper authorities if the missed used their authority. I had to do this a several time while in the military, and after I retried as well.
Personally after the way you attacked this person by assuming they text, blokc traffic and etc. with out proof, makes me think ( I stated think ) that you might be just as free to abuse your authority, and power invested you because of your rank. You scare me, and I am more scared of the military leadership, today then I am of law enforcement officers.
Wonder if you be the one the first to round up law abiding citizens should the Marxists every get the control they want in this country.

"You do not know what information they may have been given." I don't care what information they were given since I know what action I took that were perfectly legal and non-threatening. In fact, I also know that I had spoken with the Chief literally 24 hours prior.

I remember when cops cared about the people than themselves. Guess the selfishness and hubris of the law enforcement community is complete. More people are murdered BY COPS than cops are murdered by people each year. The problems is they get a convenient umbrella called "qualified immunity" to kill with impunity under the guise of "I felt threatened."

I've been a member of Rally Point for quite some time. But the title of this article as well as the text of the article seem to be in conflict. Something that I haven't really seen in my entire membership with this organization.

Which leads me to believe that the article what is originally written hastily and immediately came to the defense of the officers. However it does appear that the text of the article was later changed after its author you did a lot more research and discovered what exactly had happened.

In which case I would recommend to the author that he changed the title of this article to reflect the opinions stated in the text.

Because it is drawing all sorts of negative attention from the veteran community. Any veteran community who both support the institution of law enforcement but also recognize that this particular Police Department was acting like a Mexican drug cartel.

Not sure what you mean here. I am to concern, as this to me really isn't a post for this medium in my opinion. However I am concern, how many see our law enforcement as the problem. Yes there are bad apples in the law enforcement, even in leadership.
Being a retired veteran, I know what it's like and I would think many of those on here do as well, to labeled by one or two bad apples. Living in a military town, I am sure many of you have been lumped into military are bad to rent to, sell to, and date my daughter or son. Your child may have been bullied in school. Again all because of one or two bad apples. Also many times it was only a few locals that wanted to make life bad for those of the military and their family.
It's time to get facts, stop jumping to conclusions. Make assessments based on each incident and not try to make it fit all the incidents so lump to try and prove what does not truly exist.

There are no easy explanations to a situation like this Private, and the fact that you recognize that speaks well of you.
To me it's a case of what you're entitled to do vs. a matter of good judgment. Going to a protest armed, particularly one involving the police is never a good idea IMO. You have responding officers already on edge due to the circumstances now faced with armed protestors.
