CJ Grisham, President of Open Carry Texas, Army veteran and recent candidate for State Representative in District 55, along with a couple of other people was arrested yesterday in Olmos Park, TX (Bexar County). He was tazed and subsequently injured in that arrest with a head injury and was hospitalized. I was told that the head injury was a large gash on the back of the head. He also suffered numerous scrapes on his wrists and arms.

Grisham and crew were legally opening carrying pistols and long guns in response to an event last week when an Olmos Park police officer drew guns on and detained someone with a protest sign solely for the reason of open carrying a pistol (which turned out to be a training fake).

Grisham had a phone conversation with the Olmos Park Police Chief, Rene Valenciano about their policies, etc. in which the chief seemed entirely unconcerned with his officers illegally detaining people for a perfectly legal activity. (The conversation will be linked in the comments below).

Grisham and crew went to Olmos Park yesterday and were legally and peacefully open carrying and got arrested for it. There is a video of the arrest. There was no articulated probable cause for the arrest. The police showed up, including Chief Valenciano and ordered Grisham and his crew to the ground. Grisham at least refused. It was Valenciano that personally tazed and arrested Grisham.

Between the phone call and video from the site, it's very clear this was an illegal arrest by an oath breaking police officer and they will be held accountable.

Isn’t it at this point we tell people to always do what the cops tell you to do or is that reserved only for Black people?
At least none of them were shot like the guy that was legally armed and informed the officer he was armed during a traffic stop.
Bottomline, take the same advice you’re willing to give others. Privilege only takes you so far. Sucks for him.

Just like Adof Hitler, Joseph Stalin, Mao Zedong, Fidel Castro just to name a few.
To over ride the U.S. Constitution, And the U.S. Suprem court witch Upheld the the 2nd Amendment.
District of Columba V. Heller, 554 u.s.570 (2008)
The Suptem Court of the United States held that the 2nd Amendment protectsan Indiviuales right to possess a FIREARM.

In 2008 the Gonzales, LA Police Department had to pay out on a law suit from an open carry arrest. A fellow named Mark Marchiafava was arrested and later prevailed in the suit.

Open carry is a "thing" which is legal in Texas ONLY if one has a Texas CCW or a CCW from a state which has reciprocity with Texas, i.e., each state recognizes a CCW from the other. Mr. Grisham and his followers put me in mind of those knuckleheads who claim to be "sovereign citizens" who are not subject to the laws everybody else must follow. They claimed to be "teaching the cops a lesson" by openly defying Texas law as it is written because they don't agree with it. Do that and you can expect to be arrested. The proper place for this controversy is in the Texas Legislature, not on the street.

If they were being peaceful then they were merely exercising their 1st and 2nd Amendment rights at the same time.

Amendment I:
Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances.

Amendment II
A well-regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed.

The police went overboard, those wrongfully arrested had their rights violated on two levels.

Grisham probably not aware of how many officer have been killed and probably should have followed the officers directive to go to ground as the others did; till the officers cleared up any legal issues about who was carrying legally, just cause your in an open carry state does not mean you cannot be or should not be stopped and directed to assume a position that will allow the officers to make a safe investigation as to fire arms license and legal permit. So as for me, not feeling this guys pain.

"open carry state does not mean you cannot be or should not be stopped and directed to assume a position that will allow the officers to make a safe investigation as to fire arms license and legal permit" So with this kind of thinking anyone can be stopped and "directed to assume the position". Unless you you know that he has committed a crime you have no right to shake him down because someone somewhere else was harmed by a bad guy, so you must be a bad guy too.....assume the position. What's next shaking folks down for a copy of a pocket constitution like the Boy Scouts used to give out (it might offend a socialist libtard somewhere, or how about using my cell phone unlawfully.....I heard someone somewhere had child porn on one.....assume the position will I make a safe investigation!!! Is this really where we are in America? Please don't try to say guns are dangerous and he might do something, that is just your fear talking and the media produced hysteria manipulating the weak minded into staying in their cages.
If he was carrying concealed they would not have treated him the same way. They just don't like what he was doing a fully lawful behavior and exercising his rights. He didn't commit and crime and wasn't suspected of committing a crime why are you and why would you want them to detain him?

Really nothing to be conflicted about, the police chief is in the wrong and put his personal feelings into it and violated their constitutional rights! He needs to be relieved of duty and the officers as well

I am a retired Texas cop. And Vietnam vet. And guns do not freak me out. Open carry people are posers, I get that. But when they tell you to get on the ground, just do it. Sheesh. Make your point later, with an attorney. You do not know what the cop was told on his radio on the way to your event.

Chief Valenciano was definitely in the wrong. I don't mind seeing anyone legally carrying a weapon in the open. What I do mind is a criminal doing concealed carry, that is a reason for open carry. It lessens the possibility for a criminal to commit mass murder. I hope the group had a permit for their demonstration and abiding by all rules. This Chief can expect to be liable for his extreme actions.
