I have conflicting feelings over this. I know that open carry is a thing in Texas, but who crossed the line, if anyone?

CJ Grisham, President of Open Carry Texas, Army veteran and recent candidate for State Representative in District 55, along with a couple of other people was arrested yesterday in Olmos Park, TX (Bexar County). He was tazed and subsequently injured in that arrest with a head injury and was hospitalized. I was told that the head injury was a large gash on the back of the head. He also suffered numerous scrapes on his wrists and arms.
Grisham and crew were legally opening carrying pistols and long guns in response to an event last week when an Olmos Park police officer drew guns on and detained someone with a protest sign solely for the reason of open carrying a pistol (which turned out to be a training fake).
Grisham had a phone conversation with the Olmos Park Police Chief, Rene Valenciano about their policies, etc. in which the chief seemed entirely unconcerned with his officers illegally detaining people for a perfectly legal activity. (The conversation will be linked in the comments below).
Grisham and crew went to Olmos Park yesterday and were legally and peacefully open carrying and got arrested for it. There is a video of the arrest. There was no articulated probable cause for the arrest. The police showed up, including Chief Valenciano and ordered Grisham and his crew to the ground. Grisham at least refused. It was Valenciano that personally tazed and arrested Grisham.
Between the phone call and video from the site, it's very clear this was an illegal arrest by an oath breaking police officer and they will be held accountable.

The only conclusion I can come to is that you’re conflicted about whether or not the constitution should be upheld. I suggest you sign up for a Civics refresher course now. WTF?!

If the story is just as presented in the opening post, it is clear the police were in the wrong.

If open carry is legal, that's the way it is. If a liberally minded police chief wants to violate the law to suit his political point of view he does so at his own risk. As for me, I prefer to conceal carry. I don't want anyone to know I have a firearm on me.

Police Officers are trained very well before they are placed on patrol. Ever Police Officer knows what constitutes a legal arrest and should know what does not constitute a legal arrest. They also know the penalties if they violate their oath and know that their fufillmate to that oath is the first priority. The Chief is so deep in this illegal arrest he should be suspended and the Texas Rangers tasked with conducting an investigation.

Its a state issue and the AG of Texas will have to deal with it. Its a crazy world. I have a concealed permit but rarely carry these days. Frankly, if I take my family out to dinner, I would prefer we didn't have to deal with a place full of pistol packing people drinking beer with their steak at Texas Roadhouse, but its their legal right to do it in most states.

Well, this is simple... the OPPD will be sued for a FORTUNE along with the officer and chief. Chief will be fired. City will be out millions in lawsuit. Grisham and buddies will be back in park doing their thing once he recovers from his less than friendly encounter. Cops need to learn the law and get their heads out of their ass!!

I hope the SOBS have deep pockets cause they be in for a heavy-duty civil suit. Their civil rights were also infringed upon. Which could bring Federal charges.

Wow, of all places Texas....the Chief was out of line and corrupt, based on what I am reading and viewing....so based on what I see and hear...Chief is going to jail...

My opinion and mine alone. This chief is an idiot who cherry picks the laws he wants to enforce. Texas is a big state so there are still liberal hotbeds here with jackasses like this running things. He was wrong and will probably get a slap on the wrist. Problem with that is one day he will attempt to arrest the wrong one and it will end with someone getting shot, more than likely him or one of his deputies. These boys down here take there 2nd amendment rights very serious and they are willing to go to jail or die for that right. Sort of like some old boys that got together over a couple hundred years ago to "form a more perfect union."
